Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests authorization to wear the Multi-National Force-Iraq shoulder patch. 2. The applicant states while deployed he worked for Blackwater conducting personal security. He fell under the direct supervision of the State Department and believes he should be authorized to wear the Multi-National Force-Iraq shoulder patch on his right sleeve. 3. The applicant provides three DD Forms 214 (Certificate of Release or Discharge from Active Duty), an Army National Guard (ARNG) Retirement Points History Statement, and a Certificate of Appreciation. CONSIDERATION OF EVIDENCE: 1. The applicant served on active duty in the U.S. Marine Corps from 21 March 1994 through 12 August 2002. 2. The applicant is shown to have had a break in service from 13 August 2002 through 21 May 2009. 3. On 10 November 2008, the applicant received a Certificate of Appreciation from the Deputy Project Manager, WPPS-HT Programs, Baghdad, Iraq for his service to the Blackwater Chief of Mission Protection Teams. 4. The applicant enlisted in the Alabama ARNG on 22 May 2009, served on active duty (Special Work orders, under Title 32, U.S. Code) from 11 April 2011 through 14 September 2011, and was commissioned a second lieutenant in the ARNG on 15 September 2011. He served on active duty for training from 16 October 2011 through 16 February 2012. 5. Army Regulation 670–1 (Wear and Appearance of Army Uniforms and Insignia) states individuals being transferred from one organization to another may continue to wear the insignia of the former unit until they report for duty at the new organization. DISCUSSION AND CONCLUSIONS: 1. The applicant was not on active duty at the time he served with Blackwater. As such he would not have been awarded or authorized to wear any military insignia for this period. 2. Further, even if he had been on active duty the Multi-National Force-Iraq shoulder patch is a unit identification badge that is only worn during the period the service member was attached to that unit.
