THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) for the period ending 8 August 1966 to show his: * social security account number (SSAN) as XXX-XX-16XX instead of XXX-XX-56XX * completion of Jungle Operations training 2. The applicant states his DD Form 214 for the period ending 8 August 1966 has the wrong SSAN and unlisted information. 3. The applicant provides: * Certificate of Training * DD Form 214 for the period ending 18 April 1965 CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant was inducted into the Army of the United States on 8 January 1964. In conjunction with his induction, the applicant completed a DD Form 398 (Statement of Personal History) that shows his SSAN as XXX-XX-16XX. 3. On 18 April 1965, he was honorably discharged to accept a commission. His DD Form 214 for this period shows in: * item 28 (Service Schools or Colleges, College Training Courses, and/or Post-Graduate Courses Successfully Completed) – * Noncommissioned Officer Preparatory Course, April 1964, 2 weeks * Infantry Officers Candidate Course, October 1964 to April 1965 * item 30 (Remarks) –SSAN XXX-XX-16XX 4. On 19 April 1965, the applicant was appointed as a Reserve commissioned officer in the rank of second lieutenant with concurrent call to active duty. 5. On 8 August 1966, he was honorably released from active duty and transferred to the U.S. Army Reserve Control Group (Annual Training). His DD Form 214 for this period shows in: * item 28 – Infantry Officers Candidate Course, 18 October 1964 to 18 April 1965 * item 30 – SSAN XXX-XX-56XX 6. The applicant provided a copy of his Certificate of Training for completion of Jungle Operations training during the period 13 through 24 September 1965. 7. Army Regulation 635-5 (Separation Documents), in effect at the time, provided instructions for preparation of the DD Form 214. This regulation stated to enter service schools, including dates and major courses successfully completed, during the period covered by the DD Form 214 in item 28. The entry also included military-sponsored courses completed in civilian schools and colleges. DISCUSSION AND CONCLUSIONS: 1. The evidence of record shows the applicant provided the requested SSAN during his induction processing. It appears his SSAN was transcribed incorrectly at the time of his release from active duty on 8 August 1966. Therefore, he is entitled to correction of his DD Form 214 for the period ending 8 August 1966 to show his SSAN as it appears on his DD Form 398. 2. The applicant's Certificate of Training shows he completed the Jungle Operations training course; therefore, he is entitled to correction of his DD Form 214 for the period ending 8 August 1966 to show this training.
