THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests award of a Foreign Language Proficiency Bonus (FLPB). 2. The applicant states he qualified for the FLPB in 2011 but never received orders or the pay. 3. The applicant provides copies of an FLPB checklist, a 21 January 2014 Memorandum for Record, a DA Form 4187 (Personnel Action), a DA Form 330 (Language Proficiency Questionnaire), his Personnel Qualification Record, and a DA Form 200 (Transmittal Record). CONSIDERATION OF EVIDENCE: 1. The applicant enlisted in the U.S. Army Reserve (USAR) on 8 March 2004, completed training, and was awarded military occupational specialty (MOS) 97E (Human Intelligence Collector). The MOS designation for Human Intelligence Collector was subsequently converted from 97E to 35M. 2. The applicant's USAR unit was mobilized on three occasions: 7 September 2008 - 25 September 2009 (Iraq), 26 September 2009 - 27 April 2010 (Afghanistan), and 6 July 2013 - 16 March 2014 (Afghanistan). 3. He completed language proficiency requirements for Tagalog-Filipino in August 2011. 4. In the processing of this case, a staff advisory opinion (COPY ATTACHED) was obtained from the U.S. Army Human Resources Command, Chief, Incentive Pay Branch. It was noted that an FLPB is granted to Soldiers who have language dependent MOS's. The Unit Manning Report, dated 7 December 2013, shows the applicant is in a language position coded for Modern Standard Arabic. In accordance with Army Regulation 11-6, Soldiers must be proficient in the control language/primary language (CLANG/PLANG) of their MOS language position to be eligible for a FLPB in subsequent languages. 5. A copy of the advisory opinion was forwarded to the applicant with no response being received from the applicant. 6. Army Regulation 11-6 (Army Foreign Language Program) implements policies and procedures for establishing Army linguist requirements of Army's command language programs and for identifying, testing, reporting, evaluating, reevaluating, training, and assigning Army linguists. It states that: a. The FLPB is a monthly monetary bonus paid to officers, warrant officers, and enlisted personnel who maintain the required proficiency in designated foreign language(s) in accordance with the Army’s needs; b. The Defense Language Office will determine which languages on the strategic language list are dominant in the force. When a language is also identified by the Army as dominant in the force, the Army will only pay FLPB to Soldiers in a language-dependent MOS/specialty or language-coded billet. c. It is the individual Soldier-linguist’s responsibility to test annually in accordance with this regulation. d. Soldiers must be assigned to a language-coded billet, designated with a specific language; and e. Soldiers must be proficient in the CLANG/PLANG assigned to their language-coded billet to be eligible for FLPB in subsequent languages. DISCUSSION AND CONCLUSIONS: 1. The applicant would qualify for consideration of an FLPB for Tagalog as a secondary language if he also qualified for his language-coded billet requirement of Modern Standard Arabic. 2. Because the applicant is not shown to have met or maintained the required proficiency for his language-coded billet, he does not meet the eligibility requirements for receipt of an FLPB.
