THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of the social security number (SSN) shown on his DD Form 214 (Certificate of Release of Discharge from Active Duty). 2. He states his SSN is incorrect and should be xxx-xx-xxx2. 3. He provides his DD Form 214. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. Having prior service in the Army National Guard (ARNG), he enlisted in the U.S. Army Reserve (USAR) on 12 April 1982. 3. His record contains a DD Form 4/1 (Enlistment/Reenlistment Document - Armed Forces of the United States) which shows that he reenlisted in the USAR on 3 April 1991. Item 2 (SSN) of this form lists his SSN as xxx-xx-xxx2. 4. He served on active duty from 27 December 1990 to 11 June 1991. Item 3 (SSN) of his DD Form 214 for this period lists his SSN as xxx-xx-xxx4. 5. His record contains a DD Form 215 (Correction to DD Form 214), dated 10 June 1992, which also list his SSN in item 3 as xxx-xx-xxx4. DISCUSSION AND CONCLUSIONS: 1. The available evidence shows that during his period of service he consistently listed his SSN as xxx-xx-xxx2. It appears that during the preparation of his DD Form 214 and DD Form 215 an administrative error occurred resulting in the SSN being incorrectly recorded as xxx-xx-xxx4. In view of the foregoing, his DD Form 214 and DD Form 215 should be corrected to reflect his SSN as it is shown on the abovementioned official document.
