THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of item 11 (Primary Specialty) of his DD Form 214 (Certificate of Release or Discharge from Active Duty).

2.  The applicant states:

	a.  Item 11 of his DD Form 214 should show he served in military occupational specialty (MOS) 94F (Computer/Detection Systems Repairer) for 4 years and 1 month and he served in MOS 42A (Human Resources Specialist) for 3 years and 4 months.

	b.  He joined the Army in April 2008 for MOS 94F and he served the entire 4 years of service.

	c.  After advanced individual training (AIT), he was reclassified into MOS 42A.  He performed duties in both MOS 42A and MOS 94F while in the service for all but 1 year.

3.  The applicant provides:

* DD Form 214
* Enlisted Record Brief (ERB)



CONSIDERATION OF EVIDENCE:

1.  The applicant enlisted in the Regular Army on 23 April 2008 for 4 years.  After completing basic training and a 20-week AIT course, he was awarded MOS 94F.

2.  Section IX (Assignment Information) of his ERB shows:

* his duty MOS as 94F from 27 June 2008 to 3 February 2009
* his duty MOS as 42A on 4 February 2009

3.  On 22 April 2012, he was honorably released from active duty for completion of required active service.

4.  His DD Form 214 shows in:

* item 11 – "94F1O COMPDETECT SYS REP – 3 YRS 4 MOS//NOTHING FOLLOWS"
* Item 12c (Net Active Service This Period) – "0004  00  00 [4 years]"

5.  There is no evidence which shows he was awarded MOS 42A.

6.  Army Regulation 635-5 (Separation Documents), in effect at the time, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army.  It established standardized policy for the preparation of the DD Form 214.  It stated to enter from the ERB the titles of all MOS's served (clarified by the U.S. Army Human Resources Command to mean held) for at least 1 year and include the number of years and months served for each MOS in item 11.  For time determination, 16 days or more count as a month.  Do not count basic training and AIT.  For an enlisted Soldier, also specify the first five characters of the primary MOS code, which includes the three characters of the MOS, the fourth character of skill and grade level in the MOS, and the fifth character of a special qualification identifier, if applicable.

DISCUSSION AND CONCLUSIONS:

1.  The applicant's contention he served in MOS 94F for 4 years and 1 month was noted.  However, evidence shows he only completed 4 years of service.

2.  Since the governing regulation instructs the DD Form 214 preparer not to count basic training and AIT as creditable time spent in a particular MOS, it is reasonable to presume he held primary MOS 94F for 3 years and 4 months, which is properly shown in item 11 of his DD Form 214.  Therefore, there is insufficient evidence on which to amend the entry in item 11 of his DD Form 214.

3.  Although he contends he served in MOS 42A for 3 years and 4 months, there is no evidence of record and he provided no evidence that shows he was awarded MOS 42A.  Only awarded MOSs are entered on the DD Form 214.  In the absence of MOS orders, the ERB entry showing his duty MOS as 42A alone is not sufficient as a basis to amend item 11 of his DD Form 214 to show this MOS.
