THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests the removal of a college transcript from his Army Military Human Resource Record (AMHRR), formerly known as the Official Military Personnel File (OMPF). 2. The applicant states that the transcript from Summit University should be removed from his AMHRR because he was unaware of Military Personnel (MILPER) Message 10-109, dated 15 April 2010. 3. The applicant provides a copy of the transcript he desires to be removed from his AMHRR. CONSIDERATION OF EVIDENCE: 1. After serving 4 years and 22 days of active service in the Marine Corps, he enlisted in the Regular Army on 20 June 1993 for a period of 4 years and training as a chemical operations specialist. He completed his training and has remained on active duty through a series of continuous reenlistments. He was promoted to the pay grade of E-8 on 1 September 2007. 2. The contested transcript is currently filed in the restricted section of his AMHRR. 3. A review of the applicant's official records failed to show any evidence he submitted a request for removal of the transcript from his official records through his chain of command. 4. On 15 April 2010, MILPER Message Number 10-109 announced the procedures for removal of fraudulent diplomas or transcripts from a Soldier’s OMPF. It provided, in pertinent part, that Soldiers were required to submit their request to have a transcript removed through their chain of command to the appropriate authority, which in this case is U.S. Army Human Resources Command. 5. Army Regulation 600-8-104 (Military Personnel Information Management/Records) governs the composition of the AMHRR, and states in pertinent part that the performance section is used for filing performance, commendatory and disciplinary data. Once placed in the AMHRR, the document becomes a permanent part of that file. The document will not be removed from or moved to another part of the AMHRR unless directed by certain agencies, to include this Board. Army Regulation 600-8-104 states, in pertinent part, that all enlisted Soldiers’ transcripts of credit from civilian colleges, universities, trade schools, or business schools are filed in the permanent section of the Performance section on the AMHRR. DISCUSSION AND CONCLUSIONS: 1. The applicant’s contention that the Summit University transcript should be removed from his AMHRR has been noted and appears to lack merit. 2. Not only does the applicant’s official records not contain any indication that he attempted to have the transcript removed using the procedures outlined in MILPER Message 10-109, he has not sufficiently explained why he submitted the transcript for filing in his official records or why he desires to have it removed. 3. Accordingly, it would not serve justice to remove the transcript from his records. 4. In view of the foregoing, there is an insufficient basis upon which to grant the requested relief.
