Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests an upgrade of his discharge under other than honorable conditions to an honorable discharge. 2. The applicant states, in effect, he: * did not get along with his first sergeant * was young and naïve * was informed that his discharge would be upgraded to honorable 3. The applicant provides a DD Form 293 (Application for the Review of Discharge from the Armed Forces of the United States, his DD Form 214 (Report of Separation from Active Duty), a self-authored statement, and three letters of support. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant's record shows he enlisted in the Regular Army on 16 August 1976 at the age of 19. The highest rank/grade he attained while serving on active duty was private (PV2)/E-2. 3. The available records indicate the applicant accepted nonjudicial punishment under the provisions of Article 15 of the Uniform Code of Military Justice (UCMJ) on 7 November 1977, for violation of a lawful regulation by purchasing in excess of the monthly quantity limitations while stationed in Korea. 4. On 13 February 1979, charges were preferred against the applicant for being absent without leave (AWOL) for the period 11 September 1978 through 5 February 1979. 5. On 13 February 1979, the applicant consulted with counsel and was advised of the basis for the contemplated trial by court-martial, the maximum permissible punishment authorized under the UCMJ, the possible effects of an under other than honorable conditions discharge, and the procedures and rights available to him. Subsequent to receiving legal counsel, the applicant voluntarily requested discharge under the provisions of Army Regulation 635-200, chapter 10 for the good of the service - in lieu of trial by court-martial. 6. In his request for discharge, the applicant indicated he understood that by requesting discharge he could be deprived of many or all Army benefits, he could be ineligible for many or all benefits administered by the Veterans Administration, and he could be deprived of his rights and benefits as a veteran under both Federal and State laws. 7. On 28 February 1979, the separation authority approved the applicant’s request and directed he receive an under other than honorable conditions discharge. 8. On 7 March 1979, the applicant was discharged accordingly. He completed 2 years, 1 month, and 23 days of total active service with 152 days of time lost due to being AWOL. 9. There is no indication he petitioned the Army Discharge Review Board for a review of his discharge within that board’s 15-year statute of limitations. 10. The applicant provides three letters of support which, in effect, state that the applicant is an upstanding citizen. 11. Army Regulation 635-200 (Active Duty Enlisted Administrative Separations) sets forth the basic authority for the separation of enlisted personnel. Chapter 10 provides that a member who has committed an offense or offenses for which the authorized punishment includes a punitive discharge may submit a request for discharge for the good of the service in lieu of trial by court-martial at any time after the charges have been preferred. A discharge under other than honorable conditions is normally considered appropriate. 12. Army Regulation 635-200, paragraph 3-7a, provides than an honorable discharge is a separation with honor and entitles the recipient to benefits provided by law. The honorable characterization is appropriate when the quality of the members service has met the standards of acceptable conduct and performance of duty for Army personnel or is otherwise so meritorious that any other characterization would be clearly inappropriate. 13. Army Regulation 635-200, paragraph 3-7b, provides that a general discharge is a separation from the Army under honorable conditions. When authorized, it is issued to a Soldier whose military record is satisfactory but not sufficiently meritorious to warrant an honorable discharge DISCUSSION AND CONCLUSIONS: 1. The applicant's contention that his discharge under other than honorable conditions should be upgraded was carefully considered and found to be without merit. 2. The applicant contends that his discharge should be upgraded because he was young and unaware of the consequences that could occur later in life. 3. Records show the applicant was only 19 years of age at the time of his offenses. However, there is no evidence that indicates the applicant was any less mature than other Soldiers of the same age who successfully completed military service. 4. The applicant contends that he was informed that his discharge would be upgraded to honorable. 5. The U.S. Army has never had a policy where a discharge was automatically upgraded. Every case is individually decided based upon its merits when an applicant requests a change in his or hers discharge. The ABCMR will warrant any changes if it is determined that the characterization of service or the reason for discharge were both improper and inequitable. 6. His record includes acceptance of nonjudicial punishment under the provisions of Article 15 of the UCMJ. 7. His record also shows he was charged with the commission of offenses punishable under the UCMJ with a punitive discharge and he voluntarily requested discharge under the provisions of Army Regulation 635-200, chapter 10, to avoid a trial by court-martial which may have resulted in a felony conviction. 8. All requirements of law and regulation were met and the rights of the applicant were fully protected throughout the separation process. Further, the applicant's discharge accurately reflects his overall record of service. 9. Based on his record of indiscipline which includes being AWOL for 152 days and violating a lawful regulation, the applicant's service clearly did not meet the standards of acceptable conduct and performance of duty for Army personnel. This misconduct rendered his service unsatisfactory. Therefore, the applicant is not entitled to his requested relief.
