THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests payment of Non-Physician Board Certification Pay (NPBCP) from August 2012 to March 2013. 2. The applicant states he is board certified as a Registered Nurse (RN) Anesthetist; therefore, he is eligible for BCP. His certification expired on 31 July 2012, which was renewed without lapse; however, the Army Nurse Corp (ANC) requires service members to send their documentation to the U.S. Army Human Resources Command (HRC) for renewal of their BCP. He was deployed from November 2011 to November 2012, in a remote area, and did not send his renewal documentation to HRC. In August 2013, he transferred to Fort Riley, KS and during a review of his Leave and Earnings Statement in December 2013 he noticed the BCP was not continued. He submitted a request to HRC to continue his BCP; however, they are only authorized to pay for the past fiscal year. Consequently, he is requesting back pay from 1 August 2012 through 20 March 2013. 3. The applicant does not provide any evidence. CONSIDERATION OF EVIDENCE: 1. On 20 September 1983, the applicant was appointed as a Reserve commissioned officer of the Army. On this same date, he executed an oath of office. On 20 October 1983, he entered active duty. On 1 March 1996, he was honorably released from active duty. 2. On 26 March 2010, he was appointed as a Regular Army ANC commissioned officer and executed an oath of office. He served in a variety of assignments and he attained the rank of major. 3. His records show he is a qualified RN who is licensed and certified by the American Association of Nurse Anesthetists. 4. On 21 April 2014, in the processing of this case, an advisory opinion was obtained from the Office of the Surgeon General (OTSG). This official stated: a. The applicant indicates he was receiving NPBCP that stopped on 31 July 2012 and he was unable to send the documentation due to deployment. He requests payment of the missing period from 1 August 2012 to 20 March 2013. Requests for NPBCP are initiated by the officer through the supporting Human Resources office. A review of the applicant's records and available special pay and finance data indicates the applicant's NPBCP was paid from 26 March 2012 to 31 July 2012. It was restarted by OTSG on 20 March 2013 with a current expiration of 31 July 2014. This period is the maximum authority this office has for BCP payments in arrears. There is no previous record of submission, authorization, or payment of BCP for the period 1 August 2012 to 19 March 2013. b. The applicant would have been eligible to receive payment for the missing 7 months from 1 August 2012 to 19 March 2013. The retroactive payment for this period is approximately $1,272.00 prior to withholding. The exact payment should be determined by the Defense Finance and Accounting Service (DFAS), utilizing a Health Professions Pay Entry Date (HPPED) or Medical Special Pay (MSP) date of 20100326 for the correct pay-rate level, 5. The advisory opinion was forwarded to the applicant; he concurred by email on 24 April 2014. DISCUSSION AND CONCLUSIONS: Based on the applicant's request, finance data, and the supporting documentation, OTSG officials determined the applicant's NPBCP was paid from 26 March 2012 to 31 July 2012. It was restarted by OTSG on 20 March 2013 with a current expiration of 31 July 2014. There is no previous record of submission, authorization, or payment of BCP for the period 1 August 2012 to 19 March 2013 even though he was eligible. In view of the foregoing, his records should be corrected as recommended below.
