THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty), for the period ending 2 December 2010, to show his rank/grade as specialist (SPC)/E-4 and his award of the Army Achievement Medal (AAM). 2. The applicant states, in effect, his DD Form 214 is incorrect. 3. The applicant provides: * his DD Form 214 * the first page of a DA Form 638 (Recommendation for Award) * orders CONSIDERATION OF EVIDENCE: 1. The applicant enlisted in the Alabama Army National Guard (ALARNG) on 6 January 2010. 2. On 13 July 2010, he entered active duty for initial entry training. He completed initial training and was awarded military occupational specialty (MOS) 31B (Military Policeman). 3. He was promoted to the rank/grade of private/E-2 by Joint Force Headquarters (JFHQ) ALARNG Orders 194-506, which were issued on 13 July 2010 and were effective 12 July 2010. 4. On 2 December 2010, he was released from active duty and returned to his ALARNG unit of assignment. The DD Form 214 he was issued at the time of his release from active duty shows he completed 4 months and 20 days of net active service. Also – * item 4a (Grade, Rate, or Rank) shows "PV2" and item 4b (Pay Grade) shows "E02" * item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized) shows he was awarded or authorized the National Defense Service Medal and the Army Service Ribbon 5. His records show he was awarded the AAM by Headquarters, 203rd Military Police Battalion Permanent Order 127-006, dated 10 May 2011. 6. He was promoted to the rank/grade of specialist/E-4 by JFHQ ALARNG Orders 007-515, which were issued on 7 January 2012 and were effective 5 January 2012. 7. On 18 February 2014, he was honorably discharged from the ALARNG. His National Guard Bureau Form 22 (Report of Separation and Record of Service) shows: * the period of service as 6 January 2010 through 18 February 2014 * item 5a (Rank) shows "SPC" and item 5b (Pay Grade) shows "E4" * item 15 (Decorations, Medals, Badges, Commendations, Citations, and Campaign Ribbons Awarded) shows, among other awards, an AAM 8. Army Regulation 635-8 (Separation Processing and Documents) provides guidance for the completion of the DD Form 214. It states the DD Form 214 is a summary of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active and prior inactive duty service at the time of the Soldier's release from active duty, retirement, or discharge. The DD Form 214 will be prepared for Reserve Component Soldiers who have completed active duty that results in the award of an MOS. DISCUSSION AND CONCLUSIONS: 1. Army Regulation 635-8 requires the DD Form 214 to document a summary of a Soldier's period of active service. In this case, the applicant's DD Form 214 covered his period of active service for training in MOS 31B. 2. During the period covered (13 July 2010 through 2 December 2010) his rank/grade was private/E-2, as verified by promotion orders. He was not promoted to the rank/grade of specialist/E-4 until 7 January 2012, well after the completion of his term of active duty for training. Additionally, the AAM he received was awarded on 10 May 2011, also after the period covered by his DD Form 214. 3. The applicant received an honorable discharge from the ALARNG on 18 February 2014. On this document are reflected both his rank/grade of specialist/E-4 as well as the award of the AAM. 4. Based upon the foregoing, there is no basis upon which to grant the relief requested.
