THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his records to show his Social Security Number (SSN) as "XXX-XX-XX28" instead of "XXX-XX-XX82." 2. The applicant states the SSN recorded on his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) is incorrect. 3. The applicant provides a copy of his DD Form 214. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant was inducted into the U.S. Army on 4 June 1969. At the time the applicant was inducted, the U.S. Armed Forces did not use the SSN for identification; he was issued a service number (SN). 3. A copy of the applicant's DD Form 47 (Record of Induction) is not available for review. However, his records contain the following pertinent documents: a. Headquarters, The School Brigade, U.S. Army Infantry School, Fort Benning, GA, Special Orders Number 308, dated 10 December 1969, that assigned the applicant to the U.S. Army Overseas Replacement Station, Fort Dix, NJ, on 4 January 1970. The Standard Name Line (SNL) of the orders shows the applicant's SSN as "XXX-XX-XX82." b. DA Form 2962 (Security Termination Statement and Debriefing Certificate), dated 2 December 1970, that shows his SSN as "XXX-XX-XX82." It also shows the applicant placed his signature on the document. 4. On 8 December 1970, the applicant was honorably released from active duty (REFRAD) and transferred to the U.S. Army Reserve (USAR) Control Group (Annual Training). Item 3 (SSN) of the DD Form 214 that he was issued at the time shows his SSN as "XXX-XX-XX82." 5. He completed his Reserve military service obligation on 3 June 1975. 6. A DD Form 1966 (Application for Enlistment – Armed Forces of the United States), completed on 12 February 1977, during the applicant's enlistment processing to reenter the U.S. Army and signed by the applicant and a recruiter, shows his SSN recorded as "XXX-XX-XX28" throughout the form. It also shows his personal data was verified, in part, with his social security card. 7. A DD Form 4 (Enlistment or Reenlistment Document – Armed Forces of the United States) shows the applicant enlisted in the USAR on 12 February 1977 for a period of 1 year using the SSN "XXX-XX-XX28." 8. Documents in the applicant's military personnel record created subsequent to 12 February 1977 consistently show his SSN as ""XXX-XX-XX28" throughout the remainder of his service. 9. Office of The Adjutant General, Reserve Components Personnel and Administration Center, St. Louis, MO, Orders 01-1003890, dated 18 January 1978, honorably discharged the applicant from the USAR effective 11 February 1978. The SNL of the orders shows the applicant's SSN as "XXX-XX-XX28." DISCUSSION AND CONCLUSIONS: 1. The U.S. Army was not using the SSN for identification purposes at the time the applicant was inducted. However, at some point after his induction into the U.S. Army on 4 June 1969, the available evidence shows his SSN was recorded in his military records as "XXX-XX-XX82" and that SSN is recorded on his 8 December 1970 DD Form 214. 2. The available evidence shows that, after a break in military service, the applicant's correct SSN was entered in his military records when he enlisted in the USAR. The Army recruiter relied upon the applicant's Social Security Card and DD Form 214 to verify his SSN and prior military service. 3. The applicant's military records subsequent to the period of service under review consistently show his SSN as ""XXX-XX-XX28", including the orders that discharged him from the USAR on 11 February 1978. 4. Therefore, it would be appropriate to correct the applicant's DD Form 214 to show his correct SSN as shown on his DD Form 4 dated 12 February 1977.
