Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to add the Bronze Star Medal. 2. The applicant states the Bronze Star Medal is not reflected on his DD Form 214. 3. The applicant provides: * DD Form 214 * General Orders (GO) Number 1905, dated 27 May 1969 * Bronze Star Medal Certificate, dated 27 May 1969 CONSIDERATION OF EVIDENCE: 1. The applicant was appointed as a Reserve commissioned officer on 6 June 1965 and entered active duty on 15 June 1967. 2. His DA Form 66 (Officer Qualification Record) shows he served in Vietnam from 2 June 1968 to 2 June 1969 and was assigned to the 110th Transportation Company from 5 June 1968 to 31 May 1969. 3. GO Number 1905, issued by Headquarters, U.S. Army Vietnam on 27 May 1969, awarded him the Bronze Star Medal for meritorious service from June 1968 to June 1969. 4. He was honorably released from active duty on 6 June 1969. His DD Form 214 shows he completed 1 year, 11 months, and 22 days of net active service. a. Item 22c (Foreign and/or Sea Service) of his DD Form 214 shows he completed 1 year of foreign service but did not list the last overseas theater in which service was performed. b. Item 24 (Decorations, Medals, Badges, Commendations, Citations and Campaign Ribbons Awarded or Authorized) of his DD Form 214 shows he was awarded or authorized the: * National Defense Service Medal * Vietnam Service Medal * Expert Marksmanship Qualification Badge with Rifle Bar c. Item 30 (Remarks) of his DD Form 214 does not list his Vietnam service. 5. Army Regulation 600-8-22 (Military Awards) states: a. The Republic of Vietnam Campaign Medal with Device (1960) was awarded by the Government of Vietnam to all members of the Armed Forces of the United States for qualifying service in Vietnam during the period 1 March 1961 through 28 March 1973. Qualifying service included assignment in Vietnam for 6 months or more. b. A bronze service star will be awarded for wear on the Vietnam Service Medal for participation in each credited campaign. Appendix B shows that during his service in Vietnam, he participated in the following four campaigns: * Vietnam Counteroffensive, Phase IV (2 April 1968 - 30 June 1968) * Vietnam Counteroffensive, Phase V (1 July 1968 - 1 November 1968) * Vietnam Counteroffensive, Phase VI (2 November 1968 - 22 February 1969) * TET 69 Counteroffensive (23 February 1969 - 8 June 1969) 6. Department of the Army Pamphlet 672-3 (Unit Citation and Campaign Participation Credit Register) lists the awards received by units serving in Vietnam. This pamphlet shows: a. The 110th Transportation Company was cited for award of the: * Meritorious Unit Commendation during the period of 10 March 1968 to 31 October 1968, by Department of the Army GO (DAGO) Number 39, dated 1970 * Meritorious Unit Commendation during the period of 1 November 1968 to 31 January 1970, by DAGO Number 51, dated 1971 b. Headquarters, United States Army Vietnam and its subordinate units were cited for award of the Republic of Vietnam Gallantry Cross with Palm Unit Citation during the period 20 July 1965 to 28 March 1973, by DAGO Number 8, dated 1974. 7. Army Regulation 635-5 (Separation Documents), in effect at the time, prescribed the separation documents that must be prepared for Soldiers upon retirement, discharge, or release from active duty service or control of the Active Army. It established standardized policy for preparing and distributing the DD Form 214. The instructions specified: a. for item 22c, enter the total active duty service performed outside the continental limits of the United States for the period covered by the DD Form 214 and the last overseas theater in which service was performed (e.g., U.S. Army Pacific (USARPAC)); b. for item 24, enter all decorations, service medals, campaign credits, and badges awarded or authorized from section 41 (Decorations and Awards) of the individual's DA Form 20 (Enlisted Qualification Record), omitting authorities cited therein; and c. for item 30 (Remarks), indicate Indochina and Korea service performed on or after 5 August 1964 by entering the inclusive dates of service for Vietnam and indicating "Yes" or "No" for the service in Indochina and Korea. Where the records reflect assignment to an organization in Burma, Laos, Thailand, Cambodia, or Vietnam, show "Yes" for Indochina. Sample entries are as follows: * to show service in Vietnam only – "Vietnam – 21 May 1969 to 10 June 1971, Indochina – Yes, Korea – No" * to show service in Indochina (other than Vietnam) only – "Indochina – Yes, Vietnam – No, Korea – No" * to show service in Korea only – "Indochina – No, Vietnam – No, Korea – Yes" DISCUSSION AND CONCLUSIONS: 1. GO awarded the applicant the Bronze Star Medal; therefore, he is entitled to correction of his DD Form 214 to add this award. 2. He served a qualifying period for award of the Republic of Vietnam Campaign Medal with Device (1960); therefore, he is entitled to correction of his DD Form 214 to add this award. 3. The evidence of record shows he participated in four campaigns during his service in Vietnam. Therefore, he is entitled to have four bronze service stars affixed to his previously-awarded Vietnam Service Medal. 4. During the applicant's service in Vietnam, GO awarded his unit of assignment the Meritorious Unit Commendation (2nd Award) and the Republic of Vietnam Gallantry Cross with Palm Unit Citation. Therefore, he is entitled to correction of his DD Form 214 to add these unit awards. 5. His records confirm he was assigned to Vietnam from 2 June 1968 to 2 June 1969. Therefore, he is entitled to correction of his DD Form 214 to show he served in USARPAC in item 22c and to show his Vietnam service in item 30.
