THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show: a. He was awarded the Army Commendation Medal with "V" Device, Driver and Mechanic Badge with W Bar, Noncommissioned Officer Professional Development Ribbon (NCOPDR) with Numeral 1, Army Good Conduct Medal (1st Award), "OCONUS" award, Overseas Service Ribbon, Meritorious Unit Commendation, the Navy Unit Commendation, and the "IESR." b. He completed Combat Lifesaver Training and the Warrior Leader Course (WLC). 2. The applicant states that he has documents as proof these awards and citations should be added to his DD Form 214. The District Commander, Veteran's of Foreign Wars asked him to provide the authorizations to wear his awards on Memorial Day 2014. 3. The applicant provides copies of – * DA Form 638 (Recommendation for Award) for the Army Commendation Medal with "V" Device * memorandum showing Army concurrence for the 1st Marine Expeditionary Force Navy Unit Commendation * Permanent orders for the Meritorious Unit Commendation * National Guard Bureau (NGB) Form 22 (Report of Separation and Record of Service) * DD Form 214 ending 3 November 2007 CONSIDERATION OF EVIDENCE: 1. The applicant enlisted in the Indiana Army National Guard on 13 December 2004. He held military occupational specialty 11B (Infantryman). 2. His record shows: a. He served on active duty 2 January 2005 to 15 April 2005 when he was honorably released from active duty training. The DD Form 214 for that period of active duty shows he was awarded the National Defense Service Medal and the Army Service Ribbon. b. He completed the Combat Lifesaver Course on 21 May 2006 and the WLC on 12 July 2008. 3. He last served on active duty from 13 July 2006 to 3 November 2007 when he was honorably released from active duty (REFRAD). His DD Form 214 for that period of service shows he served in Kuwait/Iraq from 3 October 2006 to 22 September 2007 and was awarded the – * Army Commendation Medal * Army Achievement Medal * National Defense Service Medal * Global War on Terrorism Service Medal * Humanitarian Service Medal * Iraq Campaign Medal * Army Service Ribbon * Overseas Service Ribbon * Armed Forces Reserve Medal with "M" Device * Combat Infantryman Badge 4. The applicant provides: a. Documentation showing he was awarded the Army Commendation Medal with "V" Device on 23 September 2007 while assigned to Detachment 4 (Forward), Headquarters and Headquarters Company (HHC), 2nd Battalion, 152nd Infantry, Camp Ramadi, Iraq. b. U.S. Army Human Resources Command (HRC), Alexandria, Virginia, memorandum, Subject: Army Concurrence for the 1st Marine Expeditionary Force Navy Unit Commendation. The applicant's unit is listed as participating with the 1st Marine Expeditionary Force. c. HRC Permanent Orders 233-24, dated 21 August 2009, showing the applicant's unit, HHC, 2nd Battalion, 152nd Infantry Regiment, was cited for award of the Meritorious Unit Commendation for the period 18 October 2006 to 16 September 2007. d. NGB Form 22 for the four-year period ending 31 December 2008 showing that in addition to the awards listed on his DD Forms 214 he was awarded the "IESR," the Army Good Conduct Medal (1st Award) (effective 3 November 2011), the Driver and Mechanics Badge with W Bar, and the "OCONUS" award. 5. Army Regulation 600-8-22 (Military Awards) states: a. A bronze service star is authorized for wear with the Iraq Campaign Medal for participation in each credited campaign. The applicant's service in Iraq coincides with the following campaigns – * National Resolution (16 December 2005-9 January 2007) * Iraqi Surge (10 January 2007-31 December 2008) b. The NCOPDR was established by the Secretary of the Army on 10 April 1981. It is awarded to Active Army, Army National Guard, and U.S. Army Reserve Soldiers for successful completion of designated NCO professional development courses. Effective 30 March 1989, a service member will be awarded the NCOPDR with the numeral which identifies the highest level of NCOES successfully completed as follows: * 1 = Bar Ribbon Device = Primary Level * 2 = Basic Level * 3 = Advanced Level * 4 = Senior Level 6. The "IESR" and "OCONUS" awards are not listed as authorized awards in Army Regulation 600-8-22. 7. Army Regulation 635-5 (Separation Documents), in effect at the time, states in paragraph 2-1 that the DD Form 214 is a summary of a Soldier’s most recent period of continuous active duty. It provides a brief, clear cut record of active duty service at the time of release from active duty, retirement, or discharge. For item 14 (Military Education) list in-service training courses; title, number of weeks, year successfully completed during the period of service covered by the DD Form 214. DISCUSSION AND CONCLUSIONS: 1. Orders show he was awarded the Army Commendation Medal with "V" Device on 23 September 2007. 2. Orders also show his unit was cited for award of the Meritorious Unit Commendation and the Army concurrence with the award of the Navy Unit Commendation to his unit. 3. His record shows he served in Kuwait/Iraq from 3 October 2006 to 22 September 2007. Therefore, he is authorized two bronze service stars to be worn on his already-awarded Iraq Campaign Medal. 4. These awards should be added to his DD Form 214. 5. His NGB Form 22 shows he was awarded the Army Good Conduct Medal (1st Award) effective 3 November 2011, the date on which he had completed a period of active duty service of more than one year. Although the orders authorizing this award are not available, it would be appropriate to add the award to his DD Form 214. 6. Based on the available records, it cannot be determined when he was awarded the Driver and Mechanic Badge with W Bar shown on his NGB Form 22. In the absence of documentation showing when he was awarded this badge, it would not be appropriate to add it to his DD Form 214 at this time. 7. The Noncommissioned Officer Professional Development Ribbon with Numeral 1 is not authorized to be listed on his DD Form 214 because he completed WLC after he left active duty. 8. The "IESR" and "OCONUS" awards are not authorized to be recorded on his DD Form 214 because they are not listed as authorized awards in the governing regulation. 9. His records show he was not on active duty when he completed the Combat Lifesaver Course. This course should not be added to his DD Form 214. The Board determined the evidence presented is sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by: a. deleting from his DD Form 214 ending 3 November 2007 the Iraq Campaign Medal; and b. adding to his DD Form 214 the – * Army Commendation Medal with "V" Device (1st Oak Leaf Cluster) * Army Good Conduct Medal (1st Award) * Iraq Campaign Medal with two bronze service stars * Meritorious Unit Commendation * Navy Unit Commendation 2. The Board further determined that the evidence presented was insufficient to warrant a portion of the requested relief.
