Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests that he be granted 6 months of constructive service credit. 2. The applicant states that he was certified as a medical technologist on 27 September 2010 and from January 2011 until he was commissioned he had professional experience as a civilian medical technologist. He should have been granted 6 months of constructive service credit. 3. The applicant provides copies of his certificate as a medical technologist, Standard Form 50-B (Notification of Personnel Action), and oath of office. CONSIDERATION OF EVIDENCE: 1. The applicant was serving as a U.S. Army Reserve (USAR) medical laboratory specialist in the pay grade of E-6 when he was commissioned as a USAR second lieutenant in the Medical Service Corps on 14 April 2011. He was not granted any constructive service credit. 2. He accepted a Regular Army appointment on 5 April 2012 and was promoted to the rank of first lieutenant on 13 April 2013. 3. In the processing of this case a staff advisory opinion was obtained from Headquarters, U.S. Army Recruiting Command (USAREC) which opines that the applicant is entitled to be awarded 1 month and 20 days of constructive credit. USAREC officials opine that the applicant was only entitled to constructive service credit for his work experience from 4 January to 13 April 2011. The advisory opinion was provided to the applicant for comment and to date no response has been received by the staff of the Board. 4. Department of Defense Instruction (DODI) 6000.13 (Medical Manpower and Personnel) provides, in pertinent part, that credit for one-half year for each year of experience up to a maximum of three years of constructive credit may be granted for experience in a health profession if such experience is directly used by the Military Service concerned. DISCUSSION AND CONCLUSIONS: 1. The applicant’s contention that he is entitled to additional constructive service credit for his professional experience has been noted and appears to have partial merit. 2. The applicant should have been granted 1 month and 20 days of constructive service credit for his work experience during the period 4 January to 13 April 2011, the day before he was commissioned. 3. Accordingly, he should be issued a new DA Form 5074-1 (Record of Award of Entry Grade Credit) reflecting 1 month and 20 days of constructive service credit. 4. Additionally, any adjustments that are applicable to his date of rank (DOR) should be made by officials at the U.S. Army Human Resources Command (HRC). As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by Issuing the applicant a new DA Form 5074-1 reflecting 1 month and 20 days of constructive service credit for work experience and adjustments made to his DOR by the HRC as applicable to his case. 2. The Board further determined that the evidence presented was insufficient to warrant a portion of the requested relief.
