THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests removal of the following documents from his Official Military Personnel File (OMPF) in the interactive Personnel Electronic Records Management System: * U.S. Total Army Personnel Command memorandum, dated 30 July 1998, subject: Notification of Promotion Status * U.S. Total Army Personnel Command memorandum, dated 4 May 1999, subject: Notification of Promotion Status 2. The applicant states: * the documents were generated by an erroneous promotion date * the erroneous documents were removed from his microfiche in 2000; however, they reappeared in 2004 and were marked "void" 3. The applicant provides email and two voided documents: U.S. Total Army Personnel Command memorandum, dated 30 July 1998, subject: Notification of Promotion Status; and U.S. Total Army Personnel Command memorandum, dated 4 May 1999, subject: Notification of Promotion Status. CONSIDERATION OF EVIDENCE: 1. The applicant was appointed as a Reserve commissioned officer in the rank of second lieutenant on 20 May 1993. 2. He was promoted to the rank of first lieutenant effective 28 May 1996. 3. He provided voided copies of the following documents from his OMPF: a. U.S. Total Army Personnel Command memorandum, dated 30 July 1998, subject: Notification of Promotion Status, stating he was considered but not selected for promotion; and b. U.S. Total Army Personnel Command memorandum, dated 4 May 1999, subject: Notification of Promotion Status, stating he was considered but not selected for promotion. 4. The interactive Personnel Electronic Records Management System shows the contested documents were filed in his OMPF on 17 December 2004 and have been marked "void." 5. There is no evidence of record and the applicant failed to provide evidence indicating the contested documents were removed from his OMPF in 2000. 6. He is currently serving on active duty in the U.S. Army Reserve Active Guard Reserve Program in the rank/grade of major/O-4. REFERENCES: 1. Army Regulation 135-155 (Army National Guard and U.S. Army Reserve – Promotion of Commissioned Officers and Warrant Officers Other Than General Officers), paragraph 2-10, provides that mandatory selection boards will convene each year. These boards will consider Army National Guard of the United States and U.S. Army Reserve officers on the Reserve Active Status List for promotion to captain through lieutenant colonel. First consideration for promotion will occur well in advance of the date the officer will complete the time-in-grade requirements in table 2-1. This may allow officers in the grades of first lieutenant through major to be promoted on or before their maximum time in grade. Table 2-1 shows the maximum time in grade for promotion from first lieutenant to captain as 5 years. 2. Army Regulation 600-8-104 (Army Military Human Resource Records Management) prescribes Army policy for the creation, utilization, administration, maintenance, and disposition of the OMPF. a. The purpose of the OMPF is to preserve permanent documents pertaining to enlistment, appointment, duty stations, assignments, training, qualifications, performance, awards, medals, disciplinary actions, insurance, emergency data, separation, retirement, casualty, and any other personnel actions. b. Appendix B is the source for documents authorized for filing in the OMPF. Depending on the purpose, documents will be filed in the OMPF in one of three folders: performance, service, or restricted. Once placed in the OMPF, the document becomes a permanent part of that file. c.  Appendix B shows letters of notification to officers considered for promotion but not selected are filed in the service folder of the OMPF. DISCUSSION: 1. The applicant was promoted to first lieutenant effective 28 May 1996. He was not eligible for mandatory promotion consideration for captain earlier than on or about 28 May 2001. 2. He contends the contested documents were removed from his OMPF in 2000. Since these documents were filed in his OMPF on 17 December 2004 and have been marked "void," it is reasonable to presume the documents rendered in 1998 and 1999 were declared void and previously removed from his OMPF and refiled at this much later date. 3.
