Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests reconsideration of his earlier request for correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to reflect award of a second Valorous Unit Award (VUA). 2. The applicant states the second VUA was awarded to his unit after the date of his discharge and he would like his DD Form 214 corrected to reflect all awards and decorations he earned during his honorable service. 3. The applicant provides U.S. Army Human Resources Command Permanent Orders 070-17, dated 10 March 2008. CONSIDERATION OF EVIDENCE: 1. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20090008020 on 15 October 2009. 2. The applicant enlisted in the Regular Army on 13 July 2000. He was assigned to Troop L, 3d Squadron, 3d Armored Cavalry Regiment, from 10 July 2001 through 13 July 2006. 3. He deployed with the above unit in support of Operation Iraqi Freedom on two occasions – from 16 April 2003 through 27 February 2004 and from 6 March 2005 through 13 February 2006. 4. He was honorably released from active duty on 22 September 2006 upon his expiration term of service. His DD Form 214 shows he was awarded or authorized the: * Bronze Star Medal * Army Commendation Medal (2nd Award) * Army Achievement Medal * Valorous Unit Award * Army Good Conduct Medal (2nd Award) * National Defense Service Medal * Iraq Campaign Medal * Global War on Terrorism Expeditionary Medal * Global War on Terrorism Service Medal * Noncommissioned Officer Professional Development Ribbon (2nd Award) * Army Service Ribbon * Overseas Service Ribbon (2nd Award) * Combat Action Badge * Driver and Mechanic Badge with Driver-W Bar 5. U.S. Army Human Resources Command Permanent Orders 070-17, dated 10 March 2008, announced award of the VUA to the 3d Squadron, 3d Armored Cavalry Regiment, for extraordinary heroism against an armed enemy during Operation Iraqi Freedom during the period 20 July 2005 to 14 January 2006. 6. U.S. Army Human Resources Command Permanent Orders 232-02, dated 19 August 2008, announced award of the VUA to the 3d Armored Cavalry Regiment for extraordinary heroism in action against an armed enemy in support of Operation Iraqi Freedom during the period 25 April 2003 to 18 September 2003. 7. Both above-referenced VUAs covering the periods 25 April 2003 to 18 September 2003 and 20 July 2005 to 14 January 2006 are now reflected in the U.S. Army Human Resources Command Awards and Decorations Branch list of approved Global War on Terrorism unit awards. 8. The applicant previously applied to the ABCMR for correction of his DD Form 214 to show additional individual and unit awards. The Board granted partial relief on 15 October 2009. His request for a second award of the VUA was disapproved based on the lack of permanent orders awarding a second VUA to his unit or annotation of the second VUA in the U.S. Army Human Resources Command Awards and Decorations Branch list of approved Global War on Terrorism unit awards. His request for campaign stars for his Iraq Campaign Medal was granted. 9. Army Regulation 670-1 (Wear and Appearance of Army Uniforms and Insignia) states unit awards are authorized for permanent wear by an individual who was assigned and present for duty with the unit at any time during the period cited or who was attached to and present for duty with the unit for at least 30 consecutive days of the period cited. DISCUSSION AND CONCLUSIONS: 1. The applicant's request for reconsideration of his earlier request for a second award of the VUA was carefully considered and found to have merit. 2. He was assigned to the 3d Squadron, 3d Armored Cavalry Regiment, and twice forward deployed with that unit to Iraq from 16 April 2003 to 27 February 2004 and from 6 March 2005 through 13 February 2006. 3. Permanent orders reflect the 3d Armored Cavalry Regiment was twice awarded the VUA during periods the applicant was assigned and forward deployed with the unit. 4. The applicant's DD Form 214 currently only reflects award of one VUA. Therefore, it would be appropriate to correct his DD Form 214 by adding the second VUA.
