THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show: * His first name is spelled “” instead of "" * His date of birth (DOB) as vice * He was awarded the Armed Forces Expeditionary Medal, North Atlantic Treaty Organization (NATO) Medal, and Army Achievement Medal (2nd Award) * He was deployed to Bosnia from 1 March to 2 November 1997 * He was deployed to Iraq in 1998 2. The applicant states he served honorably and deserves to have his military records reflect his entire military career correctly. His DD Form 214 (Certificate of Release or Discharge from Active Duty) does not provide an accurate account of his military service. Typographical errors were made when his name and DOB were recorded on the DD Form 214. Not having an accurate record of his military service is preventing him from receiving the benefits and services from the Department of Veteran Affairs (VA) that he earned. 3. The applicant provides copies of his: * social security card showing his name as " P_____" * State of California Birth Certificate showing his name as " P____" and his DOB as "" * California Identification Card showing his name as " P____" and his DOB as "" * DA Form 638 (Recommendation for Award) for the Army Commendation Medal which was downgraded to the Army Achievement Medal CONSIDERATION OF EVIDENCE: 1. The applicant enlisted in the Regular Army on 30 July 1996. He held military occupational specialty 96R (Ground Surveillance Systems Operator). 2. A DD Form 4 (Enlistment/Reenlistment Document Armed Forces of the United States) shows in item 1 (Name (Last, First Middle)) "P____, Jamie, Lawrence." Item 6 (DOB) shows "." 3. He was honorably discharged due to disability with severance pay effective 11 December 2000, in the rank of sergeant/E-5. He had completed 4 years, 4 months, and 12 days of active service. His DD Form 214 shows in: a. Item 1 (Name (Last, First, Middle)): P____, ; b. Item 5 (DOB): 0; c. Item 12f (Foreign Service): "0000 00 00"; d. Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) – * Army Good Conduct Medal * Noncommissioned Officer Professional Development Ribbon * Army Service Ribbon * Expert Marksmanship Qualification Badge with Grenade Bar * Sharpshooter Marksmanship Qualification Badge with Automatic Rifle Bar e. Item 18 (Remarks): No entry showing deployment. 4. The applicant provides a DA Form 638 showing he was awarded the Army Achievement Medal on 11 May 1999 for the period 2 December 1996 to 29 July 1999. The recommendation shows his previous award as the Army Achievement Medal and that he served on Operation Joint Guard from 1 March to 2 November 1997 in Bosnia-Herzegovnia. In his recommendation the Company Commander stated in part, "He has served the Army with distinction on deployments to Europe, SWA (southwest Asia), and NTC (National Training Center)." 5. The Defense Finance and Accounting Service (DFAS) verified the applicant received hostile fire/imminent danger pay (HF/IDP) for Bosnia from 5 April through 19 October 1997 (6 months and 15 days) and for Kuwait from 20 August through 30 December 1998 (4 months and 11 days). 6. His records contain copies of orders showing he was awarded the Army Achievement Medal on 11 May 1999 and the Driver's Badge (Wheel and Track) (properly named the Driver and Mechanic Badge with W (wheeled vehicles) and T (tracked vehicles) Bars) on 27 May 1998. 7. Army Regulation 600-8-22 (Military Awards) states: a. In pertinent part, for award of the Armed Forces Expeditionary Medal for qualifying service after 1 July 1958 in U.S. military operations, U.S. operations in direct support of the United Nations, and U.S. operations of assistance for friendly foreign nations. Qualifying service for this award includes participation in the Former Republic of Yugoslavia, Operations Joint Endeavor and Joint Guard, from 1 June 1992 to 20 June 1998 (Only for participants deployed to Bosnia-Herzegovina/Croatia). b. The NATO Medal was authorized by the Secretary-General of NATO for specific NATO operations. The Secretary of Defense may approve acceptance and wear by U.S. service members who meet the criteria specified by the Secretary-General of NATO. 8. Army Regulation 635-5 (Personnel Separations - Separation Documents) at the time prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It establishes standardized policy for the preparation of the DD Form 214. It states: a. for an active duty Soldier deployed to a foreign country with his or her unit during their continuous period of active service, the statement "SERVICE IN (NAME OF COUNTRY DEPLOYED) FROM (inclusive dates for example, YYYYMMDD - YYYYMMDD)" will be entered in item 18. b. for item 12f, enter the total amount of foreign service completed during the period covered by the DD Form 214. DISCUSSION AND CONCLUSIONS: 1. His DD Form 4 shows he enlisted using the DOB of . An incorrect DOB is shown on his DD form 214. 2. DFAS confirmed the applicant was deployed to Bosnia from 4 May through 19 October 1997 (6 months and 15 days) and to Kuwait from 20 August to 20 December (4 months and 11 days). His DD Form 214 should be corrected to show this deployed service. 3. Orders show the applicant was awarded the Driver and Mechanic Badge with W and T Bars. Additionally, he served a qualifying period of service for award of the Armed Forces Expeditionary Medal. These awards should be added to his DD Form 214. 4. The applicant’s DA Form 638 shows he was awarded a second Army Achievement Medal. It should be shown on his DD Form 214 as the Army Achievement Medal (2nd Award). 5. There is no available evidence showing he served in Iraq. 6. There is no available evidence showing he was awarded the NATO Medal. The evidence is insufficient to correct his DD Form 214 to show this award. 7. The spelling of his name on his DD Form 214 is the same he provided upon entering the military. He has established no basis for correcting the spelling of the first name on his DD Form 214. The Board determined the evidence presented is sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by: a. deleting the entry in Item 5 of his DD form 214 and replacing it with the DOB listed on his certificate of live birth; b. deleting the current entry in item 12f of his DD Form 214 and replacing it with "0000 10 26" (showing 10 months and 26 days of foreign service); c. adding to item 13 of his DD Form 214 the Army Achievement Medal (2nd Award), Driver and Mechanic Badge with W and T Bars, and the Armed Forces Expeditionary Medal; and d. adding to item 18 of his DD Form 214: * "Service in Bosnia 5 April to 19 October 1997" * "Service in Kuwait 20 August to 30 December 1998” 2. The Board further determined that the evidence presented was insufficient to warrant a portion of the requested relief.
