THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of her DD Form 214 (Certificate of Release or Discharge from Active Duty) to show the: * Global War on Terrorism Expeditionary Medal instead of the Global War on Terrorism Service Medal * Valorous Unit Award * Army Good Conduct Medal 2. The applicant states the Global War on Terrorism Service Medal should be the Global War on Terrorism Expeditionary Medal due to the fact that she served 15 months in Baghdad, Iraq, from May 2003 to August 2004. 3. The applicant provides copies of the following: * Orders Number 106-13 * Permanent Order (PO) Number 091-115 * Proof of Service memorandum * Valorous Unit Award certificate and citation * DD Form 214 CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provide in the statute of limitations, the ABCMR has elected to conduct a substantive review of the cases and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are sufficient bases to waive the statute of limitations. 2. The applicant enlisted in the Regular Army on 11 July 2000 and she held military occupational specialty 92G (food service specialist). 3. She provided copies of the following: a. Orders Number 106-13, issued by Headquarters, 1st Armored Division on 16 April 2003, reassigned her to Kuwait in support of Operation Enduring Freedom (OEF) from on or about 26 April 2003 through 25 April 2004. The orders show she was assigned to the 127th Combat Support Battalion. b. PO Number 091-115, issued by the 55th Personnel Services Battalion on 31 March 2004, awarding her the Army Good Conduct Medal (1st Award) for the period from 11 July 2000 through 10 July 2003. The orders show she was assigned to the 127th Aviation Support Battalion. 4. Her records contain the following: * Certificate, dated 15 August 2004, showing she was awarded the Army Commendation Medal for the period 6 May 2003 through 15 August 2004; the certificate shows she was assigned to Headquarters Supply Company, 127th Aviation Support Battalion * Orders Number 223-02, dated 19 August 2004, assigning her to the U.S. Army Reserve (USAR) Control Group with a release from active duty date of 15 October 2004; the orders show she was assigned to HHC, 127th Aviation Support Battalion 5. She also provided copies of the following: a. A Proof of Service memorandum, dated 15 August 2004, certifying the applicant was assigned to Headquarters Supply Company, 127th Aviation Support Battalion, 4th Aviation Brigade, and served in support of the 1st Armored Division Task Force during Operation Iraqi Freedom (OIF) from 6 May 2003 through 15 August 2004. b. A Valorous Unit Award Certificate, dated 30 September 2004, showing the 4th Brigade Combat Team, 1st Armored Division, received the award for extraordinary heroism from 15 April through 20 July 2004. c. A Valorous Unit Award Citation stating the award was issued to the 4th Brigade Combat Team, 1st Armored Division, composed of the 1st and 2nd Battalions, 501st Aviation Regiment; 69th Chemical Company; 127th Aviation Support Battalion; and the 1st Squadron, 1st Cavalry Regiment for extraordinary heroism, valor, and gallantry from 15 April through 20 July 2004. 6. She was honorably released from active duty on 15 October 2004 and was transferred to the USAR Control Group. She was credited with completing 4 years, 3 months, and 5 days of net active service this period. Her DD Form 214 lists in: * Item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized) – * Army Commendation Medal * National Defense Service Medal * Army Service Ribbon * Overseas Service Ribbon * Global War on Terrorism Service Medal * Item 18 (Remarks) – the entry, "Service in Iraq during the period of 20030506 to 20040726" 7. Army Regulation 600-8-22 (Military Awards) states: a. The Global War on Terrorism Expeditionary Medal is authorized for award to members of the Armed Forces of the United States who deployed abroad for service in Global War on Terrorism operations on or after 11 September 2001 to a date to be determined. Initial award of the Global War on Terrorism Expeditionary Medal is limited to service members deployed abroad in support of OEF, OIF, and Operation New Dawn. b. The Global War on Terrorism Service Medal is authorized for award to all Soldiers on active duty having served 30 consecutive days or 60 nonconsecutive days in support of OEF from 11 September 2001 to a date to be determined and OIF from 19 March 2003 through 31 August 2010. Servicemembers may be awarded both the Global War on Terrorism Expeditionary Medal and the Global War on Terrorism Service Medal if they meet the criteria for both awards; however, the qualifying period used to establish eligibility for one award cannot be used to justify eligibility for the other award. DISCUSSION AND CONCLUSIONS: 1. PO awarded the applicant the Army Good Conduct Medal (1st Award) for her period of service from 11 July 2000 through 10 July 2003. This award is not listed on her DD Form 214. 2. She served in support of OEF and OIF completing two qualifying periods of service for award of both the Global War on Terrorism Expeditionary and Service Medals. She also served a qualifying period of service with the 127th Aviation Support Battalion, for award of the Valorous Unit Award.
