Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show he entered active duty on 4 October 2011. 2. The applicant states his DD Form 214 currently shows he entered active duty on 4 November 2011. It should read 4 October 2011. The Department of Veterans Affairs discovered the error as the Department of Defense records show he entered active duty on 4 October 2011 and he is eligible for the maximum educational benefit at the 100-percent rate. He is currently attending vocational training and needs the 100-percent rate so he can continue. The 30-day difference in his active duty entry date is reducing his maximum educational benefit to the 90-percent rate. He did not catch the error during separation processing. 3. The applicant provides: * DD Form 214 * Military Entrance Processing Station Orders 1277036, dated 4 October 2011 CONSIDERATION OF EVIDENCE: 1. Section B (Agreements) of the applicant's DD Form 4 (Enlistment/ Reenlistment Document – Armed Forces of the United States) shows he enlisted in the U.S. Army Reserve on 18 March 2011 for a period of 8 years under the Delayed Entry Program with an obligation to enlist in the Regular Army for a period of 3 years not later than 4 October 2011. Section F (Discharge from/Delayed Entry/Enlistment Program) of his DD Form 4 shows he was discharged from the U.S. Army Reserve Delayed Entry Program on 3 October 2011 for immediate enlistment in the Regular Army. 2. Military Entrance Processing Station Orders 1277036, dated 4 October 2011, show his initial entry training reporting date as 4 October 2011. 3. He was honorably released from active duty on 3 October 2014 after completing 3 years of net active service. 4. His DD Form 214 shows the following entries: * item 12a (Date Entered Active Duty This Period) – 4 November 2011 * item 12b (Separation Date This Period) – 3 October 2014 * item 12c (Net Active Service This Period) – 3 years REFERENCES: Army Regulation 635-8 (Separation Processing and Documents) prescribes policy and procedural guidance relating to transition management. It establishes standardized policy for preparation of the DD Form 214. It states the DD Form 214 is a summary of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty, retirement, or discharge. The instructions for item 12a state to enter the beginning date of the continuous period of active duty for issuance of this DD Form 214 for which a DD Form 214 was not previously issued. Do not depend on basic active service date for this data item. The basic active service date can be an adjusted date. Data sources are enlistment contract(s), initial orders to active duty, active duty orders, previously issued DD Forms 214, DA Form 1506 (Statement of Service – For Computation of Length of Service for Pay Purposes), and a complete review of the Soldier's official record. DISCUSSION: 1. The evidence of record shows the applicant enlisted in the Regular Army and entered active duty on 4 October 2011. 2.
