THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of her DD Form 214 (Certificate of Release or Discharge from Active Duty) to show she was awarded a second Army Commendation Medal (ARCOM). 2. The applicant states she was awarded an ARCOM with First Oak Leaf Cluster on 17 May 1984, which is not reflected on her DD Form 214. 3. The applicant provides an ARCOM (First Oak Leaf Cluster) Certificate and a DD Form 214 CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. On 23 July 1978, she was appointed in the Regular Army as a second lieutenant (2LT). She completed training in the area of concentration of 92A (Supply and Service Management Officer). 3. A DA Form 2-1 (Personnel Qualification Record) item 9 (Awards, Decorations and Campaigns) shows she was awarded the: * Army Service Ribbon (ASR) * Overseas Service Ribbon (OSR) * ARCOM (2nd Award) 4. Permanent Orders 38-1 issued by Headquarters, U.S. Army Armament, Munitions and Chemical Command dated 17 May 1984, show the applicant was awarded an ARCOM (First Oak Leaf Cluster) for the period 7 June 1982 to 31 May 1984. 5. On 31 May 1984, she was honorably released from active duty and transferred to the U.S. Army Reserve Reinforcement Group. Her DD Form 214 shows she was awarded or authorized the: * ASR * OSR * ARCOM * Marksman Marksmanship Qualification Badge with Rifle Bar (M-16) DISCUSSION AND CONCLUSIONS: Permanent Orders 38-1 dated 17 May 1984, show she was awarded the ARCOM (2nd Award) for the period 7 June 1982 to 31 May 1984. Therefore, she is entitled to correction of her DD Form 214 to show this award.
