THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Report of Separation from the Armed Forces of the United States) to show award of the Bronze Star Medal with "V" Device and the Bravery Gold Medal of Greece. 2. The applicant states although he was awarded the Bronze Star Medal with "V" Device, it was not added to his DD Form 214. He further states his unit was subsequently awarded the Bravery Gold Medal of Greece which also is not reflected on his DD Form 214. 3. The applicant provides: * General Orders Number 2 * General Orders Number 390 CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant was called from inactive duty and he entered active duty in the rank/grade of second lieutenant/O-1 on 1 June 1951, in Van Wert, OH. 3. Section 28 (Chronological Record of Military Service) of his WD AGO Form 66 (Officer's, Warrant Officer's and Flight Officer's Qualification Record) shows he served as a medical assistant from 17 September to 21 December 1951 with Medical Company, 7th Cavalry Regiment. 4. Item 41 (Awards, Decorations, and Citations) of this form further shows General Orders Number 390, issued by Headquarters, 1st Cavalry Regiment, dated 6 December 1951, awarded him the Bronze Star Medal with "V" Device. 5. He was honorably released from active military service on 30 November 1953. He completed 2 years, 7 months, and 2 days of net service for pay purposes with no lost time. One year, 11 months, and 14 days of this service was overseas service. The DD Form 214 he was issued shows award of the: * Purple Heart * National Defense Service Medal * United Nations Service Medal * Combat Medic Badge * Korean Service Medal with 3 bronze service stars * Distinguished Unit Citation 6. The applicant provides General Orders Number 2, issued by the Department of the Army, Washington, D.C., dated 2 February 1956, which announced award of the Bravery Gold Medal of Greece to several units to include members of the 7th Cavalry Regiment. 7. Army Regulation 600-8-22 (Military Awards) provides policy, criteria, and administrative instructions concerning military awards and decorations. It states the Republic of Korea War Service Medal is awarded to members of the U.S. Armed Forces who served in Korea and adjacent waters between 25 June 1950 and 27 July 1953. DISCUSSION AND CONCLUSIONS: 1. General orders awarded him the Bronze Star Medal with "V" Device. 2. Evidence confirms the Bravery Gold Medal of Greece was subsequently awarded to members of the 7th Cavalry Regiment for service during a period in which the applicant was assigned. 3. The applicant served honorably during the period 1 June 1951 through 30 November 1953. He served in Korea and he participated in three campaigns as evidenced by his previously-awarded Korean Service Medal with three bronze service stars. Based on his service and award of the Korean Service Medal he is entitled to award of the Republic of Korea War Service Medal.
