THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his social security number (SSN) on his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge).

2.  The applicant states his SSN should read xxx-46-xxxx not xxx-43-xxxx.  He needs the correction to properly access his records.

3.  The applicant provides copies of his SSN card and his DD Form 214.

CONSIDERATION OF EVIDENCE:

1.  Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice.  This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so.  While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file.  In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.

2.  The applicant served on active duty in the Regular Army (RA) from 16 November 1965 through 13 November 1968 and in the inactive Reserves until 15 November 1971.

3.  During his period of service the principle identification number was the Army Service Number not the SSN.

4.  Both SSN's are utilized on the limited forms requiring an SSN that are of record. 

	a.  The following forms utilize the xxx-46-xxxx number –

* DD Form 398 (Statement of Personal History) dated 13 November 1965
* DA Form 20 (Enlisted Qualification Record) 
* computer data input punch card
* 27 April 1970 transfer orders
* 3 November 1971 discharge order 

5.  The following forms utilize the xxx-43-xxxx number –

* 13 November 1968 separation orders 
* DD Form 214

6.  The SSN card provided shows his SSN as xxx-46-xxxx.

DISCUSSION AND CONCLUSIONS:

1.  When the applicant enlisted in the RA in 16 November 1965, he was identified principally by his Army service number with limited records utilizing the SSN which is listed inconsistently in his record.

2.  The applicant's record should be uniform in regards to his SSN.  As his record is inaccurate, it would be appropriate to correct his DD Form 214 to show his SSN as it is shown on his social security card.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending his DD Form 214 to show his SSN as shown on his social security card.
