THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant request correction of her DD Form 214 (Report of Separation from Active Duty) to show her social security number (SSN) as 262-XX-XXXX instead of 256-XX-XXXX. 2. The applicant states she found out her SSN was incorrect on her DD Form 214 when she went to the Department of Veterans Affairs to apply for benefits. 3. The applicant provides: * DD Form 214 * Driver’s License * Certificate of Birth * hand written note * Affidavit of Amendment to Birth Record * social security card CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 18 March 1969. Her DD Form 4 (Enlistment Contract - Armed Forces of the United States) shows her SSN as 262-XX-XXXX. 3. The applicant’s record shows SSN 262-XX-XXXX on the following documents: * VA Form 29-8282 (Servicemen’s Group Life Insurance Election) * DA Form 20 (Enlisted Qualification Record) * Da Form 2173 (Statement of Medical Examination and Duty Status) 4. On 28 January 1970, she was discharged for the purpose of immediate reenlistment. The DD Form 214 issued at that time shows the SSN 262-XX-XXXX. 5. A DD Form 4 signed on 29 January 1970 shows her SSN as 262-XX-XXXX. 6. On 28 January 1974, she was honorably discharged. The DD Form 214 issued at that time listed her SSN as 256-XX-XXXX. 7. Records show she consistently used SSN 262-XX-XXXX throughout her service. 8. She provided a copy of her social security card that shows her SSN is 262-XX-XXXX. 9. Army Regulation 635-5 (Separations Documents), in effect during the applicant's active duty service, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It established standardized policy for the preparation of the DD Form 214. It stated the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active service. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge. DISCUSSION AND CONCLUSIONS: The applicant enlisted under the SSN 262-XX-XXXX. The SSN she disclosed at that time is consistent with the SSN used throughout her military service. One can only conclude that a typographical error occurred during the preparation of her final DD Form 214.
