THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests, in effect, correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his social security number (SSN) as 075-XX-XXXX. 2. The applicant states: * the SSN shown on his DD Form 214 is incorrect * he needs his DD Form 214 corrected because he is applying for benefits 3. The applicant provides: * DD Form 214 * social security card * birth certificate * two training certificates CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant's complete military records are not available for review. The case is being considered using the documents provided by the applicant. 3. The applicant's DD Form 214 shows: * he was ordered to active duty for training as a member of the Puerto Rico Army National Guard on 12 July 1972 * he was honorably released from active duty for training on 17 November 1972 * his SSN is listed as 076-XX-XXXX 4. The applicant provided a copy of his social security card that shows his SSN as 075-XX-XXXX and his birth certificate that was issued on 27 February 2015. 5. He also provided two certificates of training that show he completed the Field Wireman Course and the Skills Qualification Test Seminar. His training certificate for the Field Wireman Course shows his SSN as 075-XX-XXXX and his training certificate for the Skills Qualification Test Seminar shows his SSN as 075-XX-XXXX (the last four digits are completely different from all other source documents). 6. Army Regulation 635-5 (Separation Documents), in effect at the time, established standardized policy for preparing and distributing the DD Form 214. It provided that the purpose of the separation document is to provide an individual with documentary evidence of his or her military service. The instructions stated to transcribe the SSN from the individual's DA Form 2139 (Military Pay Voucher). DISCUSSION AND CONCLUSIONS: It appears the applicant's SSN was transcribed incorrectly at the time of his release from initial active duty for training on 17 November 1972. His certificate of training for the Field Wireman Course completed on 16 November 1972 shows his SSN as it is appears on his social security card. This is sufficient evidence on which to base correction of his DD Form 214 to show his SSN as it appears on his social security card.
