Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of her DD Form 214 (Certificate of Release or Discharge from Active Duty) to show the Armed Forces Expeditionary Medal and Armed Forces Service Medal. 2. The applicant states, in effect, the above awards were issued or awarded to members who served during her period of service; however, they were awarded after she was separated. She went to apply for a job and they asked about her awards and decorations, which are not listed on her DD Form 214. 3. The applicant does not provide any additional evidence. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant’s records show she enlisted in the Regular Army on 2 December 1992 and she held military occupational specialty 31R (Multichannel Transmission Systems Operator/Maintainer). 3. She served in Germany from around June/July 1993 to June/July 1996. She was assigned to Company C, 440th Signal Battalion. Her exact dates of service are unknown: a. On 29 December 1995, at Cambrai Fritsch Kaserne, Darmstadt, Germany, she executed an 8-month extension of her enlistment contract to meet the 1-year service remaining requirement for a stateside assignment. b. On 12 December 1995, she was awarded the Army Good Conduct Medal by authority of permanent orders issued by 55th Personnel Service Battalion, Darmstadt Squad, Germany. 4. She was honorably released from active duty on 1 July 1997 by reason of completion of required active service. Her DD Form 214 shows she completed 4 years and 7 months of active service. It also shows in: * Item 12f (Foreign Service), 3 years * Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) - * Army Achievement Medal (2nd Award) * North Atlantic Treaty Organization Medal * Army Good Conduct Medal * National Defense Service Medal * Army Lapel Button * Armed Forces Service Medal * Army Service Ribbon * Overseas Service Ribbon * Expert Marksmanship Qualification Badge with Grenade Bar * Marksman Marksmanship Qualification Badge with Rifle Bar * Item 18 (Remarks) does not show service in an imminent danger pay area 5. An email, dated 20 October 2015 from the Defense Finance and Accounting Service confirms the applicant received hostile fire pay/imminent danger pay from 8 January to 3 May 1996 for service in Bosnia. 6. Army Regulation 600-8-22 (Military Awards) provides for award of the Armed Forces Expeditionary Medal for qualifying service after 1 July 1958 in U.S. military operations, U.S. operations in direct support of the United Nations, and U.S. operations of assistance for friendly foreign nations. Qualifying service for this award includes participation in the Former Republic of Yugoslavia, Operations Joint Endeavor and Joint Guard, from 1 June 1992 to 20 June 1998 (Only for participants deployed to Bosnia-Herzegovina/Croatia). 7. MILPER Message Number 99-100 permits, as an exception to policy, award of the Armed Forces Expeditionary Medal as well as the Armed Forces Service Medal for participation in Operation Joint Endeavor for the period 1 June 1992 through 19 December 1996. 8. Army Regulation 635-5 (Separation Documents) establishes the standardized policy for preparing and distributing the DD Form 214. Chapter 2 contains guidance on the preparation of the DD Form 214. It states for an active duty Soldier deployed with his or her unit during their continuous period of active service, the statement "SERVICE IN (NAME OF COUNTRY DEPLOYED) FROM (inclusive dates for example, YYYYMMDD-YYYYMMDD)" is entered in item 18. DISCUSSION AND CONCLUSIONS: 1. During her foreign service tour in Germany from around June/July 1993 to around June/July 1996, the applicant deployed with her unit and served in Bosnia from 8 January to 3 May 1996 in support of what appears to be Operation Joint Endeavor. This period of service qualifies her for award of the Armed Forces Service Medal; however, her DD Form 214 already reflects this award. Without additional evidence, it is unknown if this award was for her service in Bosnia or if she served another qualifying period of service for this award. 2. The applicant served in Bosnia from 8 January to 3 May 1996. This period of service qualifies her for award of the Armed Forces Expeditionary Medal and correction of her DD Form 214 to show this award. 3. Item 18 of her DD Form 214 should also be corrected by adding the entry "SERVICE IN BOSNIA FROM 19960108 – 19960503." As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by: * adding to item 13 of her DD Form 214 the Armed Forces Expeditionary Medal (Bosnia) * adding to item 18 of her DD Form 214 the entry "SERVICE IN BOSNIA FROM 19960108 - 19960503" 2. The Board further determined that the evidence presented is insufficient to warrant a portion of the requested relief.
