THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant, the daughter of a deceased former service member (FSM), requests correction of the date of birth (DOB) recorded in his military records. 2. The applicant states that the FSM's DOB is "3 19XX" (not "12 19XX"). 3. The applicant provides copies of: * her driver license * the FSM's DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) * the FSM's death certificate CONSIDERATION OF EVIDENCE: 1. A DD Form 4 (Enlistment Record – Armed Forces of the United States) shows the FSM enlisted in the Army National Guard (ARNG) of the United States (ARNGUS) and Alabama ARNG (ALARNG) on 24 September 1965 for a period of 6 years. Item 15 (DOB) shows the entry, "12 Mar XX" (i.e., 12 19XX). 2. The FSM was ordered to active duty for training (ADT) on 6 February 1967 for a period of 19 weeks. 3. An SF [Standard Form] 88 (Report of Medical Examination), prepared on 22 May 1967 for the purpose of the FSM's release from ADT, shows in item 12 (DOB) the entry, "3 Dec XX" (i.e., 3 19XX) and the examining physicians placed their signatures on the document. 4. The FSM's DD Form 214 shows he was honorably released from ADT on 5 June 1967 to revert to the control of the ALARNG. It also shows in item 9 (DOB) the entry, "12 MAR XX" (i.e., 12 19XX). 5. In support of the application, the applicant provides a copy of a State of Alabama, Center for Health Statistics, Certificate of Death, that shows the FSM died on 24 February 2015. Item 13 (DOB) shows the entry, "Dec 3, 19XX" (i.e., 3 19XX). (The death certificate also shows he was divorced.) 6. Army Regulation 635-5 (Personnel Separations - Separation Documents), in effect at the time, prescribes policies and procedures regarding separation documents. The purpose of a separation document is to provide the individual with documentary evidence of their military service at the time of separation. Therefore, it is important the information entered thereon is complete and accurate as of that date. a. Section III (Instructions for Preparation and Distribution of the Armed Forces of the United States Report of Transfer or Discharge) contains guidance on the preparation of the DD Form 214. It states that all available records will be used as a basis for the preparation of the DD Form 214, including enlistment documents, the Enlisted/Officer Qualification Record, and orders. b. The instructions for item 9 show, "self-explanatory." DISCUSSION AND CONCLUSIONS: 1. The evidence of record shows the FSM's DOB was incorrectly recorded in his military service records when he initially enlisted in the ARNGUS and ALARNG. However, at some point during his ADT, his correct DOB was recorded in his military service records. 2. Therefore, it would be appropriate at this time to correct the FSM's records to show his correct DOB, as recommended below.
