Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) ending 24 July 1983 to show he was awarded the Belgian Parachutist Badge. 2. The applicant states that he earned the Belgian Parachutist Badge while on active duty and it should be listed on his DD Form 214. 3. The applicant provides copies of the Headquarters, 1st Personnel Command memorandum providing him authorization to accept the award and a copy of the certificate. CONSIDERATION OF EVIDENCE: 1. The applicant enlisted in the Regular Army (RA) on 28 June 1973. He reenlisted on 31 March 1975, 31 December 1977, and 25 July 1980. 2. He was honorably discharged on 24 July 1983. His DD Form 214 shows in Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) the– * Army Service Ribbon * Parachutist Badge * Expert Marksmanship Qualification Badge with Rifle and Grenade Bars * Army Good Conduct Medal * National Defense Service Medal * Noncommissioned Officer Professional Development Ribbon * Overseas Service Ribbon 5. His DA Form 2-1 (Personnel Qualification Record – Part II) shows he served in Italy from 9 August 1976 through 9 August 1978 and from 24 October 1979 through 18 October 1982. 6. Orders show he was awarded the Army Good Conduct Medal (3rd Award) for the period 27 June 1979 to 26 June 1982. 7. He provided a 23 June 1980, Headquarters 1st Personnel Command, letter showing he was authorized to accept the Belgian Parachutist Badge that was awarded to him on 4 June 1980. Authorization was also provided to record the award in his military personnel records. 8. Army Regulation 600-8-22 (Military Awards) states: a. Commanders serving in the rank of brigadier general or higher and colonel-level commanders who exercise general court-martial authority are delegated authority to approve the acceptance, retention, and permanent wear of foreign badges listed in appendix D of this regulation. Foreign qualification and special skill badges may be accepted if awarded in recognition of meeting the criteria, as established by the foreign government concerned, for the specific award. Only those badges which are awarded in recognition of military activities and by the military department of the host country are authorized for acceptance and permanent wear. Badges which do not meet these criteria may be authorized for acceptance, but not for wear, and will not be entered in the official military records of the recipient. b. the Overseas Service Ribbon was established by the Secretary of the Army on 10 April 1981. Effective 1 August 1981, all members of the Active Army, Army National Guard, and Army Reserve in an active Reserve status are eligible for the award for successful completion of overseas tours. The award may be awarded retroactively to those personnel who were credited with a normal overseas tour completion before 1 August 1981 provided they had an Active Army status on or after 1 August 1981. Numerals are used to denote the second and subsequent awards of the Overseas Service Ribbon. DISCUSSION AND CONCLUSIONS: 1. The applicant was authorized to accept the Belgian Parachutist Badge which was awarded to him on 4 June 1980. Authorization was also granted to record the award in his military personnel records. 2. He served a qualifying period of service for award of the Overseas Service Ribbon (2 Awards). 3. Orders show he was awarded the Army Good Conduct Medal (3rd Award) for the period 27 June 1979 to 26 June 1982. 4. The above awards should be added to his DD Form 214.
