THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of her DD Form 214 (Certificate of Release or Discharge from Active Duty) to show: * her correct social security number (SSN) * a Certificate of Achievement * her completion of the Basic Leader Course and the Manual Supply System and DLOGS Course * she held a top secret clearance * she was permanently retired due to physical disability 2. The applicant states: * her SSN is 490-XX-XXXX but her DD Form 214 shows her SSN as 409-XX-XXXX * her DD Form 214 does not show training she completed while on active duty * she was granted a top secret security clearance, which can be verified by her military records * her DD Form 214 should show that she was permanently retired on 17 October 1990 3. The applicant provides copies of her DD Form 214, DD Form 215 (Correction to DD Form 214), a Certificate of Achievement, 2 Certificates of Training, and her Certificate of Retirement. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant's military records are not available for review. The Board requested her military records from the repository in St. Louis, Missouri, but without success. This case is being considered based on the documents she provides. 3. The applicant is requesting correction of her DD Form 214 to show her correct SSN; however, she provided a DD Form 215, dated 26 March 1991, which corrected her DD Form 214 to show her correct SSN. Since the correction has already been completed, this portion of her request will not be discussed further in this Record of Proceedings. 4. Her DD Form 214 shows she enlisted in the Regular Army on 28 December 1981. 5. A Certificate of Training shows she successfully completed the Basic Leadership Course, conducted by the 1st Corps Support Command, Fort Bragg, NC, which she attended from 22 October to 5 November 1982 (2 weeks). 6. A Certificate of Training shows she successfully completed the Manual Supply System and DLOGS Course, which she attended from 25 to 29 June 1984 (1 week). 7. She was awarded a Certificate of Achievement for her selection as the 15th Signal Brigade's Noncommissioned Officer (NCO) of the Quarter for the fourth quarter of fiscal year 1988. 8. The level of security clearance she was granted while on active duty cannot be determined due to the unavailability of her military records. 9. Her DD Form 214 shows she was placed on the Temporary Disability Retired List (TDRL) on 23 February 1989. The DD Form 214 also shows in: a. block 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized), she was awarded or authorized the Army Service Ribbon, NCO Professional Development Ribbon, Drill Sergeant Badge, Army Good Conduct Medal (2nd Award), and Overseas Service Ribbon; b. block 14 (Military Education), the entries "Primary Leadership Development Course – 4 Weeks (1986)" and "Drill Sergeant School – 9 Weeks (1986)." c. block 28 (Narrative Reason for Separation), the entry "Physical Disability-Temporary." 10. A Certificate of Retirement shows she was retired from the U.S. Army on 17 October 1990. 11. Army Regulation 635-5 (Separations Documents), in effect during the applicant's active duty service, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It established standardized policy for the preparation of the DD Form 214 and stated: a. The DD Form 214 is a synopsis of the Soldier's most recent period of continuous active service. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge. b. A DD Form 214 will not be prepared for Soldiers being removed from the TDRL. c. In block 13, list awards and decorations for all periods of service in the priority sequence specified in Army Regulation 600-8-22 (Military Awards). d. In block 14, list in-service training courses by title, number of weeks, and year successfully completed during this period of service; e.g., medical, dental, electronics, supply, administration, personnel, or heavy equipment operations. This information is to assist the member after separation in job placement and counseling; therefore, training courses for combat skills will not be listed. 12. Army Regulation 635-5 did not provide for the recording of training courses of less than 1-week in duration on the DD Form 214 or the recording of security clearance levels. 13. Army Regulation 600-8-22 does not identify certificates of achievement, letters of appreciation/commendation, and similar documents as items that are to be recorded on the DD Form 214. DISCUSSION AND CONCLUSIONS: 1. The documentation provided by the applicant confirms she completed the Basic Leadership Course conducted by the 1st Corps Support Command, Fort Bragg, NC, from 22 October to 5 November 1982 (2 weeks). This course is not listed on her DD Form 214. 2. The evidence also shows she completed the Manual Supply System and DLOGS Course, which she attended from 25 to 29 June 1984 (1 week). This course is not listed on her DD Form 214. 3. There are no provisions in Army regulations that authorize the recording of certificates of achievement or security clearance levels on the DD Form 214. 4. The applicant's last day on active duty was 23 February 1989. She was then retired due to a physical disability, temporary. Accordingly, the entry "Physical Disability-Temporary" was entered in block 28 of her DD Form 214. Therefore, the narrative reason for separation shown on her DD Form 214 is accurate. 5. According to applicable Army regulations, a DD Form 214 will not be prepared for Soldiers being removed from the TDRL. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding to block 14 of her DD Form 214 the entries: * Basic Leadership Course, 2 Weeks, 1982 * Manual Supply System and DLOGS Course, 1 week, 1984 2. The Board further determined that the evidence presented is insufficient to warrant a portion of the requested relief.
