Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show: * Completion of the Air Assault Course * Marksmanship qualification with the M-60 machine gun 2. The applicant states he completed the Department of the Army Air Assault Course in September 1989 but the training is not shown on his DD Form 214. 3. The applicant provides a copy of a DA Form 87 (Certificate of Training). CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant’s failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant’s failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. On 26 September 1988, the applicant enlisted in the Regular Army. He completed basic combat training at Fort Leonard Wood, Missouri. 3. On 26 November 1988, the applicant was enrolled in advanced individual training as an ammunition specialist at Fort Ord, California. He was subsequently awarded the corresponding military occupational specialty 55B1O. 4. On 26 January 1989, the applicant departed Fort Ord for enrollment in the Basic Airborne Course at Fort Benning, Georgia. He successfully completed this training and was awarded the Parachutist Badge. 5. On 17 February 1989, the applicant departed Fort Benning, Georgia for duty at Schofield Barracks, Hawaii, where he was assigned to Company A, 25th Supply and Transportation Battalion, 25th Infantry Division. 6. On 15 April 1991, the applicant departed Hawaii enroute to the Presidio of San Francisco. 7. On 18 April 1991, the applicant was discharged from active duty. He completed 2 years, 6 months, and 23 days of creditable active duty service. His DD Form 214 shows: a. Item 11 (Primary Specialty): 55B1P, Ammunition Specialist with parachutist qualification; b. Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized): * Army Achievement Medal * National Defense Service Medal * Army Service Ribbon * Parachutist Badge * Expert Marksmanship Qualification Badge with Rifle Bar * Sharpshooter Marksmanship Qualification Badge with Grenade Bar * Army Lapel Button c. Item 14 (Military Education): Ammunition Specialist 5 weeks January 1989//Nothing Follows. 8. The applicant’s DA Form 2-1 (Personnel Qualification Record) shows: a. Item 9 (Awards, Decorations and Campaigns): Qualification with rifle and hand grenade with corresponding badges, Parachutist Badge, Army Achievement Medal, and National Defense Service Medal. b. Item 17 (Civilian Education and Military Schools): Ammunition Specialist training in 1989 and the Basic Airborne Course in 1989. 9. The applicant has provided a photocopy of a DA Form 87 indicating that he successfully completed an 80-hour Air Assault Course in September 1989 that was given at Schofield Barracks, Hawaii. 10. Army Regulation 600-8-22 (Military Awards) states award of the Air Assault Badge requires satisfactory completion of an air assault training course according to the U.S. Army Training and Doctrine Command standardized Air Assault Core Program of Instruction, or completion of the standard Air Assault Course while assigned or attached to the 101st Airborne Division (Air Assault) after 1 April 1974. Permanent awards of badges, except basic marksmanship qualification badges, identification badges, and the Physical Fitness Badge are announced in permanent orders by commanders. 11. Army Regulation 635-5 (Separation Documents), as then in effect, provided detailed instructions for completing separation documents, including the DD Form 214. The DD Form 214 is a summary of a Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of active duty service at the time of release from active duty, retirement, or discharge. DISCUSSION AND CONCLUSIONS: 1. The applicant contends that his DD Form 214 should be corrected to show completion of the Air Assault Course and qualification with the M-60 machine gun. 2. The available evidence of record shows that the applicant was awarded an ammunition specialist MOS with parachutist qualification. However, his military record does not contain any permanent orders for award of the Air Assault Badge or any other corroborating documentation to support the training certificate he has provided showing he successfully completed the Air Assault Course. 3. There is no evidence of record indicating that the applicant had qualified with the M-60 machine gun. 4. In view of the above, the applicant’s request should be denied.
