THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty), for the period ending 2 April 1990, to show his social security number (SSN) as "423-XX-XXXX" instead of "414-XX-XXXX." 2. The applicant states he has been trying to get this matter resolved for quite some time. He has enclosed a copy of his DD Form 214 and other items as proof. His DD Form 214 shows his SSN as "414-XX-XXXX"; however, his SSN is "423-XX-XXXX." 3. The applicant provides copies of his DD Form 214, Orders D-01-406327, issued by the U.S. Army Reserve Personnel Center, St. Louis, Missouri on 25 January 1994, a letter from the National Personnel Records Center (NPRC), St. Louis, Missouri dated 5 February 2015, his social security card, and his State of Alabama Commercial Driver License. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 18 March 1986. His DD Form 4 (Enlistment/Reenlistment Document – Armed Forces of the United States) shows his SSN as "414-XX-XXXX." He authenticated this document with his signature in all of the appropriate places, attesting to the accuracy of the data therein. 3. He was honorably released from active duty and transferred to the U.S. Army Reserve (USAR) on 2 April 1990. Item 3 (SSN) of his DD Form 214 shows his SSN as "414-XX-XXXX." 4. His record is void of documentation that shows he sought correction of his SSN during his period of active military service. 5. He completed a DA Form 4187 (Personnel Action) on 15 May 1990, as a member of a USAR Troop Program Unit, wherein he requested correction of his records to show his SSN as "423-XX-XXXX." On this form, he contends his SSN was erroneously entered on his enlistment contract as "414-XX-XXXX." 6. Orders D-01-406327, issued by the U.S. Army Reserve Personnel Center, St. Louis, Missouri on 25 January 1994, discharged him from the USAR effective 25 January 1994. These orders show his SSN as "423-XX-XXXX." 7. The documents in his military personnel records jacket (MPRJ) that span his period of active service covered by his DD Form 214 identify him by SSN "414-XX-XXXX." When required, he authenticated various documents by placing his signature where necessary. 8. The documents in his MPRJ that span his period of USAR service following his period of active service identify him by SSN "423-XX-XXXX." When required, he authenticated various documents by placing his signature where necessary. 9. He provides copies of his social security card, which shows his SSN as "423-XX-XXXX," and his State of Alabama Commercial Driver License, which does not show his SSN. 10. Army Regulation 635-5 (Separation Documents) establishes the standardized policy for preparing and distributing the DD Form 214. The regulation directs that the purpose of the separation document is to provide the individual with documentary evidence of his or her military service. It is important that information entered on the form should be complete and accurate. DISCUSSION AND CONCLUSIONS: 1. The evidence of record shows the applicant enlisted in the Regular Army on 18 March 1986 using SSN "414-XX-XXXX." He consistently used this SSN throughout his entire period of active military service. He authenticated many documents by placing his signature in the appropriate block, further establishing the correctness of this SSN. 2. Following his release from active duty and transfer to the USAR, he requested correction of his records to show his SSN as "423-XX-XXXX." He used that SSN throughout the remainder of his USAR service. He now provides a copy of his social security card that shows his SSN as "423-XX-XXXX." 3. The evidence shows he served under the SSN he claims is correct. He submitted his social security card to establish his correct SSN. It appears his SSN is incorrectly listed on his DD Form 214. Therefore, it would be appropriate to correct his DD Form 214 to show his SSN as it is listed on his social security card.
