THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests, in effect, correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge), item 25 (Education and Training Completed) to show he completed the following training: * advanced individual training (AIT) in military occupational specialty (MOS) 11B (Light Weapons Infantryman) * Basic Airborne Course 2. The applicant states, in effect, he completed the above training, but his DD Form 214 does not provide proof of this. 3. The applicant provides: * two DD Forms 214 * DA Form 20 (Enlisted Qualification Record) * Department of Veterans Affairs identification card CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 30 June 1966. 3. He was honorably released from active duty on 27 June 1969. His DD Form 214 shows he completed 2 years, 11 months, and 28 days of net active creditable service. a. Item 23a (Specialty Number and Title) shows MOS 76Y (Unit and Organization Supply Specialist). b. Item 25 lists the following training: * Basic Combat Training * General Supply Course * Supply Management Course 4. His available service record contains the following documents: a. DA Form 20 shows in item 28 (Specialized Training), Basic Airborne Course, 3 weeks in length, completed 16 December 1966. b. Special Orders (SO) Number 288, dated 10 November 1966, issued by Headquarters, U.S. Army School/Training Center, shows the applicant was awarded primary MOS 11B effective 19 November 1966. c. SO Number 290, dated 14 December 1966, issued by U.S. Army Infantry School, shows the applicant was awarded the Parachutist Badge for successful completion of the Basic Airborne Course effective 16 December 1966. 5. Army Regulation 635-5 (Personnel Separations - Separation Documents), in effect at the time, provided policies and procedures for the completion of the DD Form 214. With regard to entries on education and training for enlisted personnel it requires the inclusion of installation training courses (qualification courses) which have been successfully completed during the period covered by the DD Form 214. DISCUSSION AND CONCLUSIONS: 1. The applicant requests amendment of his DD Form 214 to show he successfully completed AIT for MOS 11B and the Basic Airborne Course. 2. SO show the applicant was awarded MOS 11B upon successful completion of MOS training and award of the Parachutist Badge after qualification training. Although his DD Form 214 shows other courses he completed, such as Basic Combat Training, his DD Form 214 does not reflect either 11B AIT or the Basic Airborne Course.
