THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 256A (Honorable Discharge Certificate) to show his social security number (SSN) as XXX-XX-XXX1 vice XXX-XX-XXX3. 2. The applicant states his Honorable Discharge Certificate contains an incorrect SSN. He discovered this error when he applied for a Department of Veterans Affairs loan and had to provide the certificate to the lender. 3. The applicant provides: * DD Form 256A * DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) * DD Form 4 (Enlistment Record – Armed Forces of the United States) * social security card * orders * page 1 of his DA Form 20 (Personal Qualification Record) * DD Form 398 (Statement of Personal History) * immunization record * driver's license * Selective Service System Registration Certificate * identification card CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the U.S. Army Reserve (USAR) on 8 September 1963. His DD Form 4, dated 8 September 1963, shows his SSN with the ninth digit as 1. 3. His record contains a DA Form 41 (Record of Emergency Data), dated 8 September 1963, wherein he listed his SSN with the ninth digit as 1. 4. He entered active duty for training (ADT) as a member of the USAR on 5 December 1963. He was honorably released from ADT on 22 April 1964 to the control of the USAR. 5. Item 32 (Remarks) of the DD Form 214 he was issued shows his SSN with the ninth digit as 1. 6. Special Orders (SO) Number 259, dated 16 September 1969, issued by Headquarters, First U.S. Army, Fort George G. Meade, MD, honorably discharged him from the USAR effective 7 September 1969. These orders show his SSN with the ninth digit as 3. 7. The applicant provides his Honorable Discharge Certificate that shows he was honorably discharged from the USAR on 7 September 1969. This certificate shows his SSN with the ninth digit as 3. DISCUSSION AND CONCLUSIONS: The evidence of record confirms the applicant's SSN was listed with the ninth digit as 1 upon his enlistment in the USAR. This is the SSN he used throughout his active duty and Reserve service. It appears an administrative error occurred when SO Number 259 were issued showing his SSN with the ninth digit as 3. This error was compounded when his Honorable Discharge Certificate was prepared listing his SSN with the ninth digit as 3.
