THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show – * foreign service in Iraq * award of the Army Achievement Medal * completion of training at the Armorer School * primary military occupational specialty (PMOS) 92Y (Unit Supply Specialist) 2. The applicant states that he needs this information corrected to show his experience when looking for a job. 3. The applicant provides copies of his: a. Certificate showing completion of the Unit Supply Specialist Course (22 April-11 June 2008) (10 weeks). b. Page 1 of a DA Form 638 (Recommendation for Award of the Army Achievement Medal), dated 1 December 2008. c. Certificate showing he successfully completed a 9-day PBUSE (Property Book Unit Supply Enhanced (PBUSE)) Unit Supply Clerk Course (72 hours) during the period 4-14 January 2010 at Fort Hood, TX. d. III Corps Certificate showing he passed the Unit Supply Clerk Course (14 January 2010-13 January 2012). CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 29 January 2008. 3. His Enlisted Record Brief (ERB), dated 4 March 2010, shows – * his PMOS as 92A * his awards as the National Defense Service Medal and Overseas Service Ribbon * all his duty assignments were in MOS 92Y 4. He was discharged under honorable conditions on 16 March 2010 as a private/E-2. He had completed 1 year, 11 months, and 26 days of active service. His DD Form 214 shows in: a. item 11 (Primary Specialty) 92A1O Automated Logistical – 1 year, 9 months; b. item 12f (Foreign Service) "0000 00 00" (indicating no foreign service); c. item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons awarded or Authorized) the National Defense Service Medal and the Army Service Ribbon; d. item 14 (Military Education) Automated Logistical Specialist, 12 weeks, 2008; and e. item 18 (Remarks) no entry showing deployment. 5. An email from the Defense Finance and Accounting Service, dated 26 February 2014, confirmed he received hostile fire pay (HFP)/imminent danger pay (IDP) for service in Kuwait from 3 September 2008 through 24 January 2009 (4 months and 22 days). 6. In support of his request, the applicant provides: a. Page 1 of a DA Form 638 showing he was recommended for award of the Army Achievement Medal for the period 2 September 2008 to 1 February 2009 (An ABCMR staff member contacted the applicant and he indicated he did not have the second page of the DA Form 638 to show the award was completed.) b. A U.S. Army Quartermaster School, Fort Lee, Virginia, diploma, dated 11 June 2008, showing he successfully completed the Unit Supply Specialist Course 551-92Y1O, 22 April-11 June 2008 (7 weeks). c. A Certificate of Training showing he successfully completed a 9-day PBUSE unit supply clerk course (72 hours) from 4-14 January 2010 at Fort Hood, TX. d. A III Corps certificate showing he successfully passed the PBUSE certification test and he was certified for the period 14 January 2010-13 January 2012. 7. Army Regulation 600-8-22 (Military Awards) states the Army Achievement Medal is awarded to members of the Armed Forces of the United States, who while serving in a noncombat area on or after 1 August 1981, distinguished themselves by meritorious service or achievement. As with all personal decorations, formal recommendations, approval through the chain of command, and announcement in orders are required. 8. Army Regulation 635-5 (Separation Documents), in effect the time, established the standardized policy for preparing and distributing the DD Form 214. It is important that information entered on the form be complete and accurate. The DD Form 214 is a summary of a Soldier's most recent period of continuous active service. It states that in: a. Item 11 enter the titles of all MOS or AOC served for at least 1 year and include for each MOS/AOC the number of years and months served. For time determination, 16 days or more count as a month. Do not count basic training and AIT. b. Item 12f (Foreign Service), show the total amount of foreign service completed during the period. c. item 14 (Military Education), list the formal in-service (full-time attendance) training courses successfully completed during the period of service covered by the DD Form 214. Include title, length in weeks, and year completed. d. item 18 (Remarks), for an active duty Soldier deployed to a foreign country with his or her unit during their continuous period of active service, enter the statement "SERVICE IN (NAME OF COUNTRY DEPLOYED) FROM (inclusive dates for example, YYYYMMDD - YYYYMMDD)." DISCUSSION AND CONCLUSIONS: 1. DFAS confirmed he was deployed to Kuwait during the period 3 September 2008 through 24 January 2009. His DD Form 214 should be corrected to show this foreign service/deployment. 2. The available evidence shows he completed the Unit Supply Specialist Course and the 9-day PBUSE-Unit Supply Clerk Course. His DD Form 214 should be corrected to show this military training. 3. His ERB shows he was awarded the Overseas Service Ribbon. His DD Form 214 should be corrected to show this award. 4. His DA Form 638 showing he was recommended for award of the Army Achievement Medal for his service in Iraq is not complete (the page showing award disposition is not available). His DD Form 214 should not be corrected to show he deployed to Iraq or that he was awarded the Army Achievement Medal. 5. The available evidence shows he completed training in PMOS 92Y and all his DMOS entries on his ERB show 92Y. His DD Form 214 should be corrected accordingly. 6. The III Corps certificate shows he successfully passed the PBUSE certification test and he was certified for the period 14 January 2010-13 January 2012; it does not indicate he completed military training. His DD Form 214 should not be corrected to show this certification period. 7. There is no available evidence he completed an armorer course or school. The Board determined the evidence presented is sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by: a. deleting the current entry in item 11 of his DD Form 214 and replacing it with “92Y Unit Supply Specialist – 1 YR, 9 MOS//” Nothing Follows; b. deleting the current entry in item 12f of his DD Form 214 and replacing it with “0000 04 22”; c. adding to item 13 of his DD Form 214 the Overseas Serve Ribbon; d. adding to item 14 of the DD Form 214 – * Unit Supply Specialist Course 551-92Y1O, 7 weeks, 2008 * Nine-Day PBUSE Unit Supply Clerk Course (72 hours), 2010 e. adding to item 18 of his DD Form 214 "Service in Kuwait 20080903-20090124.” 2. The Board further determined that the evidence presented was insufficient to warrant a portion of the requested relief.
