THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests reconsideration of his previous request for correction of item 28 (Narrative Reason for Separation) of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to change or delete the entry “unfitness - drug abuse.” 2. As a new request, the applicant requests correction of item 18 (Remarks) of his DD Form 214 to show his home of record (HOR) (i.e., place of birth (POB)) as Cordelle, GA, vice Cordelle, FL. 3. The applicant states the entry in item 28 of his DD Form 214 should be Cordelle, GA. 4. The applicant provides his DD Form 214. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. With respect to his request to change/delete the narrative reason for separation. a. On 3 November 2006, this Board received the applicant’s request to change his narrative reason for separation; however, his request was denied by the Board in ABCMR Docket Number AR20060015641, dated 31 May 2007. b. Army Regulation 15-185 sets forth procedures for processing requests for correction of military records and allows an applicant to request reconsideration of an earlier ABCMR decision if the request is received within 1 year of the ABCMR's original decision and it contains new evidence that was not previously considered. c. As his request for reconsideration was neither received within 1 year nor contains any new evidence, the portion of his request that pertains to the narrative reason for separation will not be discussed further in this Record of Proceedings. 3. The applicant enlisted in the Regular Army (RA) on 29 December 1972. His DD Form 4 (Enlistment Contract-Armed Forces of the United States), dated 29 December 1972, shows he enlisted at the Armed Forces Examining and Entrance Station (AFEES), Jacksonville, FL, his POB was listed as Cordelle, GA, and his HOR was listed as Tallahassee, FL. 4. His DA Form 20 (Enlisted Qualification Record), created upon his entry on active duty, shows his POB as Cordelle, FL. 5. He was discharged on 22 October 1973. Item 18 of the DD Form 214 he was issued shows his POB as Cordelle, FL. DISCUSSION AND CONCLUSIONS: The evidence of record confirms the applicant's POB was listed as Cordelle, GA, upon his enlistment in the RA. It appears an error occurred when his DA Form 20 was created and his POB was entered incorrectly. This error was compounded when his DD Form 214 was prepared with his POB listed as Cordelle, FL.
