THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant, the brother of a deceased former service member (FSM), requests correction of his brother's DD Form 214 (Certificate of Release or Discharge from Active Duty) to show his foreign service in Kuwait during Operation Intrinsic Action. 2. The applicant states that their cemetery will not allow the FSM's ashes to be interred in the military section, unless his discharge document shows his time spent on foreign soil. 3. The applicant provides copies of the FSM's: * Certificate of Appreciation * Memorandum showing he participated in Operation Intrinsic Action and is authorized the Armed Forces Expeditionary Medal * Certificate of Achievement * Separation orders * DD Form 214 * Coroner's Certificate of Death CONSIDERATION OF EVIDENCE: 1. The FSM enlisted in the Regular Army on 1 March 1996. He held military occupational specialty 63S (Heavy Wheeled Vehicle Mechanic). 2. He was released from active duty on 28 February 1999. His DD Form 214 shows in: a. item 12f (Foreign Service): "0000 00 00" (indicating no foreign service); b. item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized)– * Army Good Conduct Medal * Army Lapel Button * Army Service Ribbon * Marksman Marksmanship Qualification Badge with Rifle Bar c. item 18 (Remarks): No deployment entry. 3. In support of his request the applicant provided: a. A Headquarters, Task Force 4th Battalion, 64th Armor, memorandum, subject: Authorization to Award the Armed Forces Expeditionary Medal – Intrinsic Action Rotation 98-03 in Kuwait. The memorandum announces that, "The attached named individuals participated in Intrinsic Action rotation 98-03 from 15 August 1998 – 17 December 1998 and are therefore authorized to wear the Armed Forces Expeditionary Medal, in accordance with messages Headquarters PERSCOM 121828/JUN 96 and MILPER Message 96-027, dated 131205Z NOV 95." There is no list of attached names available. b. A Certificate of Achievement presented to the FSM for exceptionally meritorious service during Intrinsic Action 98-03. 4. An email from the Defense Finance and Accounting Service confirmed he received hazardous fire pay/imminent danger pay for service in Kuwait from 20 August through 26 December 1998 (4 months and 7 days). 5. Army Regulation 600-8-22 (Military Awards) states the Armed Forces Expeditionary Medal is authorized for participants in military operations within a specific geographic area during a specified time period. An individual who was not engaged in actual combat or equally hazardous activity must have been a bona fide member of a unit participating in or be engaged in the direct support of the operation for 30 consecutive or 60 nonconsecutive days provided this support involved entering the area of operations. Qualifying service for Southwest Asia operations includes participation in Operation Intrinsic Action (11 November 1998 to 22 December 1998). 6. Army Regulation 635-5 (Separation Documents) establishes the standardized policy for preparing and distributing the DD Form 214. It is important that information entered on the form should be complete and accurate. The DD Form 214 is a summary of a Soldier's most recent period of continuous active duty. Item 12f shows the total amount of foreign service completed during the period and for an active duty Soldier, item 18 shows the entry "SERVICE IN (Name of Country Deployed) FROM (inclusive dates for example YYYYMMDD-YYYYMMDD). DISCUSSION AND CONCLUSIONS: 1. The available evidence shows the FSM served in Kuwait from 20 August through 26 December 1998 (4 months and 7 days). 2. He served a qualifying period of service for award to the Armed Forces Expeditionary Medal. 3. His DD Form 214 should be corrected to show his foreign service and the Armed Forces Expeditionary Medal.
