Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of her records to show her transfer in the U.S. Army Reserve (USAR) from a Troop Program Unit (TPU) to the Individual Ready Reserve (IRR) was voluntary vice involuntary. 2. The applicant states she asked to go into the IRR voluntarily. She had an honorable discharge and a favorable Noncommissioned Officer Evaluation Report (NCOER) at the time. During the late 1990s, it was not uncommon to have records shipped to St. Louis to remove personnel off the Unit Manning Report. She believes her records fell into this category. 3. The applicant provides: * USAR Honorable Discharge Certificate, dated 4 January 2000 * NCOER for the rating period 199709-199808 CONSIDERATION OF EVIDENCE: 1. The applicant was born in November 1964. She enlisted in the Regular Army on 9 November 1982. She served through two reenlistments on 9 May 1986 and 9 February 1989. 2. She was honorably discharged from active duty on 30 August 1989 to enter the Reserve Officers' Training Corps (ROTC). She was assigned to the USAR Control Group (ROTC). 3. Her DD Form 214 (Certificate of Release or Discharge from Active Duty) shows she completed 6 years, 8 months, and 22 days of net active service this period. There are no records of her service from 1 September 1989 through 8 January 1994. 4. She enlisted in the USAR in the rank/grade of specialist/E-4 for 6 years on 9 January 1994. The expiration of term of service (ETS) date was established as 4 January 2000. 5. He records contain an NCOER for the rating period 199709 through 199808 for her duties as personnel administrative specialist while assigned to a TPU, the 303rd Psychological Operations Company, Pittsburgh, PA. She received a "Fully Capable" rating by her rater and a "Successful/Superior" rating by her senior rater. 6. She was honorably discharged from the USAR on 4 January 2000 and she was issued an Honorable Discharge Certificate, dated 4 January 2000. 7. After a break in service, she enlisted in the USAR on 7 October 2009. She entered active duty on 16 November 2011 and served in Kyrgyzstan/Afghanistan from 29 December 2011 to 4 November 2012. She was honorably released from active duty on 19 December 2012. 8. She reentered active duty on 28 July 2014 and she reenlisted in the USAR on 15 December 2014. She was honorably released from active duty on 30 September 2015. 9. An advisory opinion was received on 17 August 2015 from an official at the IRR/TPU/Individual Mobilization Augmentee Personnel Actions Branch of the USAR in the processing of this case. An advisory official stated: a. The applicant is requesting to have the reason for the transfer from a TPU to the IRR on 30 August 1998 changed from unsatisfactory participation to a voluntary transfer. The last known unit of the applicant in 1998 was the 2nd Psychological Operations Group, Coraopolis, PA, serviced by the 99th Regional Support Command. The order transferring her is not in iPERMS and was not provided by the applicant. There is no evidence of unsatisfactory participation. ` b. The Reserve Data Maintenance System (RDMS) reflects that on 30 August 1998, the applicant was reassigned within the USAR between a TPU and a non-unit category for unsatisfactory participation. She received an overall rating of fully capable on her NCOER for the rating period 199709 through 199808. There was no mention of unsatisfactory participation. c. Before rendering a determination, the advisory official recommended a copy of the orders be requested from the applicant. He also recommended the U.S. Army Psychological Operations Command and/or the USAR G-1 be offered an opportunity to provide a copy of the transfer order and any files related to the unsatisfactory participation of the applicant. d. The official opines that in the absence of evidence of unsatisfactory participation, relief would be appropriate. 9. The applicant was provided with a copy of this advisory opinion but she did not respond. 10. The case analyst of record contacted the applicant by phone and email in an effort to obtain her 1998 IRR transfer orders and her 2000 discharge orders. She indicated she never received any. 11. The case analyst of record contacted the 99th Regional Support Command, the higher headquarters for the 2nd Psychological Operations Group, also in an effort to obtain her 1998 IRR transfer orders and her 2000 discharge orders. The search did not yield any orders. DISCUSSION AND CONCLUSIONS: 1. No records exist to support the RDMS data indicating the applicant was transferred from her TPU to the IRR. Likewise, there are no records to show she was an unsatisfactory participant as there are no proceedings that resulted in a reassignment, transfer, or separation. The fact that she was honorably discharged from the USAR on 4 January 2000 suggests that her command determined she still had potential for useful service. 2. The evidence indicates she should have been issued an order transferring her to USAR Control Group (IRR) on or about 1 September 1998 (one day after the through date on her NCOER). 3. It is clear that administrative errors were committed in processing the applicant’s transfer. She should not be penalized.
