Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests a DA Form 1059 (Service School Academic Evaluation Report), signed on 15 June 2007, be removed from her official military personnel file (OMPF) and replaced with a DA Form 1059, signed on 14 June 2007. 2. The applicant states the DA Form 1059 from the second phase of her Basic Noncommissioned Officer Course (BNCOC) in her iPERMS (integrated Personnel Electronic Records Management System) is incorrect. Upon her departure from BNCOC she was issued an incorrect DA Form 1059. The school corrected the error and sent her a new DD Form 1059 but never filed the corrected document in her iPERMS. 3. The applicant provides: * two DA Forms 1059 * DA Form 200 (Transmittal Record) * copy of the envelope the corrected DA Form 1059 arrived in * Certificate of Training for BNCOC CONSIDERATION OF EVIDENCE: 1. The applicant is a staff sergeant in the U.S. Army Reserve (USAR) serving in a troop program unit. 2. A DA Form 1059, signed on 15 June 2007 by the rater, reviewing officer and the applicant is currently filed in her iPERMS – Performance Folder. a. In item 11 (Performance Summary) the block for "Marginally Achieved Course Standards" is checked. b. There are two entries in the lower right-hand corner of Item 14 (Comments): * "FAIL 0706" - indicating she failed her Army Physical Fitness Test (APFT) * "60/117 YES" - indicating she met height and weight standards 3. The applicant provided an undated DA Form 1059, signed on 14 June 2007 by the same rater, reviewing officer and the applicant. There are no annotations on the form identifying it as a corrected copy. a. Item 11, the block for "Achieved Course Standards," is checked. b. Item 14 contains the entry "60/117 YES" indicating she met height and weight standards. Item 14 does not contain an entry for pass or fail of the APFT. 4. The applicant provided a DA Form 200, dated 25 January 2008. Item 18 (Remarks) of the form contains the entry "CORRECTED DA 1059 FOR SSG (the applicant)." 5. In a memorandum, subject: Physical Fitness and Height and Weight Requirements for Military Institutional Training, dated 10 August 2006, the Deputy Chief of Staff, G-3/5/7, announced amendments to Army Regulation 350-1 (Army Training and Leader Development) pertaining, in part, to the disposition of Soldiers who met academic course requirements but failed APFT standards. These Soldiers were to be considered academic course graduates and were to receive a DA Form 1059 marked "Marginally Achieved Course Standards." Soldiers attending institutional training were still required to meet physical fitness standards, but failing those standards was not to result in removal from the course. 6. A change to Army Regulation 350-1, dated 19 August 2014, modified the entry on the DA Form 1059 for APFT failure from "Achieved Marginal Course Standards" to "Failed Course Standards." 7. Army Regulation 600-8-104 (Army Military Human Resource Records Management) states only documents pertaining to a Soldier’s military career will be filed in the OMPF. Once properly filed in the OMPF, the document will not be removed from the record unless directed by a specified authority, including this Board. DISCUSSION AND CONCLUSIONS: 1. The applicant contends the DA Form 1059, signed on 14 June 2007, is the correct copy that should be filed in her OMPF. 2. The undated DA Form 1059, signed on 14 June 2007, does not contain an entry for the APFT. The form is not annotated as a corrected copy. 3. The DA Form 1059, signed and dated on 15 June 2007, does contain an entry for the APFT indicating the applicant failed her APFT. As directed in the memorandum from the Deputy Chief of Staff, G-3/5/7, dated 10 August 2006, the DA Form 1059 is appropriately marked "Marginally Achieved Course Standards." 4. It appears the latest DA Form 1059 is filled in the applicant's OMPF and is in compliance with the regulation in effect at the time.
