THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Discharge or Release from Active Duty) to show his social security number (SSN) as shown on his social security card. 2. The applicant states the SSN on his DD Form 214 is not right and is not his SSN. 3. The applicant provides copies of his DD Form 214 and social security card. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. On 24 September 1986, the applicant enlisted in the U.S. Army Reserve (USAR) under the Delayed Entry Program. His DD Form 4 (Enlistment Contract – Armed Forces of the United States), dated 24 September 1986, shows his SSN as XXX-XX-. 3. On 28 October 1986, he was discharged from the USAR for the purpose of immediate enlistment in the Regular Army. He enlisted in the Regular Army on 29 October 1986 for a period of 3 years. 4. His DD Form 1966 (Record of Military Processing – Armed Forces of the United States), dated 29 October 1986, shows his SSN as XXX-XX-. 5. His DA Forms 1695 (Oath of Extension of Enlistment), dated 13 December 1989 and 12 June 1991, show his SSN as XXX-XX-. 6. His DA Form 2A (Personnel Qualification Record – Part I) and DA Form 2-1 (Personnel Qualification Record – Part II) both show his SSN as XXX-XX-. Item 3 of his DA Form 2A shows the entry "VSSN (verification status of the SSN) Code: R." 7. His records contain a Social Security Administration Form 4002 (Request for Social Security Number or Name Information), dated 1988, that shows his name or SSN did not match the agency's records at the time. His records are void of any evidence a response was provided to or from the Social Security Administration. 8. He provided a copy of his social security card issued on 6 March 2013 showing his name and SSN as XXX-XX-0350. 9. His records are void of and he failed to provide any evidence showing the SSN listed on his social security card was ever used by him during his period of military service. 10. Army Regulation 635-5 (Separation Documents), in effect at the time, established standardized policy for preparing and distributing the DD Form 214. The purpose of the separation document is to provide an individual with documentary evidence of his or her military service. The instructions stated to verify the accuracy of the SSN with item 3 of the DA Form 2. If any other letter than "V" was shown with the SSN, verification with the Soldier and his or her social security card was required. 11. Army Regulation 680-29 (Military Personnel, Organization, and Type of Transaction Codes), in effect at the time, prescribed the data code structure used to report and record personnel data. Paragraph 1-89 (Code Number 84, Verification Status SSN) shows code R as "designation unknown, referral." The SSN, name, or year of birth in the Army automated record was changed or a new record was established and the record was being referred to the Social Security Administration for verification. DISCUSSION AND CONCLUSIONS: 1. The applicant's request for correction of his DD Form 214 to show his SSN as shown on his social security card was carefully considered. 2. For historical purposes, the Army has an interest in maintaining the integrity of its records. The data and information contained in those records should reflect the conditions and circumstances that existed at the time the records were created. In the absence of a showing of material error or injustice, there is a reluctance to recommend that those records be changed. 3. While it is understandable that the applicant desires to record the SSN shown on his social security card in his military records, there is not a sufficiently compelling reason for compromising the integrity of the Army's records. Absent other Army records to the contrary, it is presumed that the applicant's military service records, including his DD Form 214, were correct at the time of preparation and there is insufficient evidence to grant him relief in this case. 4. A copy of this decisional document will be filed in his official military records. This should serve to clarify any questions or confusion regarding the difference in the SSN recorded in his military records and the SSN shown on his social security card.
