Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show award of the Armed Forces Expeditionary Medal (AFEM), two Army Achievement Medals (AAM), and Army Commendation Medal (ARCOM). 2. The applicant states: a. He was deployed in support of Operation Joint Endeavor from 1 March 1998 to 7 October 1998. He was told his unit was authorized to wear the AFEM for their deployment. He discovered the medal was not on his DD Form 214 after his separation. b. He was also awarded two AAMs and an ARCOM which are not shown on his DD Form 214. 3. The applicant provides: * ARCOM Certificates * two AAM Certificates * North Atlantic Treaty Organization (NATO) Medal Certificate * Stabilization Force identification card * deployment orders and roster * DD Form 214 CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 15 July 1997. 3. He provided deployment orders, dated 5 March 1998, showing his unit was ordered to deploy in support of Operations Joint Endeavor/Determined Effort effective 19 March 1998. 4. He provided a NATO Medal Certificate showing he was awarded the NATO Medal for service with NATO on operations in relation to the former Republic of Yugoslavia during the period 19 March 1998 to 7 October 1998. 5. The Defense Finance and Accounting Service confirmed he received hostile fire pay/imminent danger pay and combat zone tax exclusion for service in Bosnia from 22 March 1998 to 7 October 1998. 6. He also provided: a. an AAM Certificate, dated 9 November 1999, showing Headquarters, 95th Military Police Battalion, Permanent Order Number 313-03, awarded him the AAM for meritorious performance during the period 11 December 1997 to 6 December 1999; b. an AAM Certificate, dated 26 February 2001, showing Headquarters Command, Fort Myer, Permanent Order Number 57-3, awarded him the AAM for outstanding achievement during the period 26 June 2000 to 29 September 2000; and c. an ARCOM Certificate showing Headquarters, U.S. Army Garrison, Fort Myer, Permanent Order Number 218-02, dated 6 August 2002, awarded him the ARCOM for outstanding performance during the period 2 January 2000 to 30 September 2002. 7. On 14 July 2003, he was honorably released from active duty. 8. His DD Form 214 shows he was awarded or authorized the: * NATO Medal * Army Good Conduct Medal * National Defense Service Medal * Armed Forces Service Medal * Army Service Ribbon * Overseas Service Ribbon * Driver and Mechanic Badge with Driver-W Bar * Bronze German Army Marksmanship Badge 9. Item 18 (Remarks) of his DD Form 214 does not show any deployments. REFERENCES: 1. Military Personnel Message Number 99-100 authorized award of both the Armed Forces Service Medal and AFEM as a one-time exception to Department of Defense and Service policy for qualifying service in support of Operations Joint Endeavor/Joint Guard in the Republic of Bosnia-Herzegovina. This exception allowed both service medals to be presented to personnel deployed to Bosnia-Herzegovina during the periods 1 June 1992 to 19 December 1996 (Operation Joint Endeavor) and 20 December 1996 to 20 June 1998 (Operation Joint Guard). This exception also allowed only one award of each service medal for service in either or both Operation Joint Endeavor and/or Operation Joint Guard. 2. Army Regulation 635-5 (Separation Documents), in effect at the time, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It established standardized policy for preparation of the DD Form 214. The instructions stated that for an active duty Soldier deployed with his or her unit during their continuous period of active service, enter the statement "SERVICE IN (name of country deployed) FROM (inclusive dates for example, YYYYMMDD-YYYYMMDD)" in item 18. DISCUSSION: 1. Based on the applicant's deployment in support of Operations Joint Endeavor/Determined Effort and his service in Bosnia-Herzegovina from 19 March 1998 to 7 October 1998, he is authorized award of the AFEM and Armed Forces Service Medal and his deployment should be entered item 18 of his DD Form 214. 2.
