THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests, in effect, correction of her DD Form 214 (Certificate of Release or Discharge from Active Duty) to show her overseas service in Korea during 1989. 2. The applicant states she served in Korea in a temporary duty (TDY) status with the 135th Engineer Group, Missouri Army National Guard (MOARNG). 3. The applicant provides Permanent Orders (PO) Number 14-2, dated 10 May 1989. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the MOARNG on 11 March 1978. She was ordered to active duty in an Active Guard/Reserve status on 14 March 1984. 3. She retired on 15 November 2002. Her DD Form 214, item 12f (Foreign Service) shows no overseas service. 4. Her available military service record contains the following letters that show she served in a TDY status overseas. a. Letter of Commendation, date 3 April 1989, noting her dedication and proficiency during Operation Team Spirit-89. No dates are given. b. Letter of Appreciation (3-Star note, with indorsements by a major general, and brigadier general), all expressing appreciation for the applicant's service during Operation Yama Sakura XV. No dates are provided. 5. The applicant provides PO Number 14-2, date 10 May 1989, issued by the MOARNG, awarding her the MOARNG Commendation Ribbon for outstanding performance at annual training while serving in Korea during Exercise Team Spirit-89. The period of service is 9 to 29 March 1989 (a period of 21 days). REFERENCES: Army Regulation 635-5 (Personnel Separations - Separation Documents), in effect at the time, prescribed policies and procedures for completion of the DD Form 214. It stated for item 12f to enter the total amount of foreign service completed during the period of the DD Form 214. DISCUSSION: The applicant requests correction of her DD Form 214 for the period ending 15 November 2002 to show her TDY service in Korea. While her available military service record is void of any documentation showing the specific dates of such service, she provides PO showing she was recognized for outstanding performance while participating in Operation Team Spirit-89 in Korea. The period is 9 to 29 March 1989 (21 days).
