THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of item 25 (Education and Training Completed) of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show he completed the Aviation Safety Officer Course (ASOC) in 1971. 2. The applicant states: * item 25 of his DD Form 214 is incomplete at present * he graduated from the ASOC in 1971 * he has the original certificate in his possession * this course is not shown on his DD Form 214 3. The applicant provides: * ASOC completion certificate * DD Form 214 CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant entered active duty on 19 July 1966. He served as a helicopter pilot in Vietnam from 5 November 1967 to 4 November 1968. 3. He provided a certificate, dated 11 June 1971, showing he completed the ASOC. 4. He again served in Vietnam from 27 July 1971 to 4 February 1972 5. On 16 April 1972, he was released from active duty. Item 25 of his DD Form 214 does not show he completed the ASOC. REFERENCES: 1. Army Regulation 635-5 (Separation Documents), in effect at the time, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It established standardized policy for preparation of the DD Form 214. The instructions stated to enter service schools, including major courses which were successfully completed, and military sponsored courses completed in civilian schools and colleges during the period covered by the DD Form 214 in item 25. For officers, enter other courses of study and education-level tests from information contained in the DD Form 66 (Officer Qualification Record). 2. The U.S. Army ASOC website states the ASOC produces the skills necessary to manage an aviation safety program at company and battalion levels. Offered as a 6-week resident course, the ASOC is designed to train an individual on how to administer an Aviation Safety Program. DISCUSSION: The evidence shows the applicant completed the 6-week ASOC in June 1971.
