THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests the following awards be added to his DD Form 214 (Certificate of Release or Discharge from Active Duty) with a separation date of 2 December 2007: * Legion of Merit for service from 14 July 2004 to 13 July 2014 * Army Achievement Medal, 6th Award for service from 24 March 2014 to 4 April 2014 2. The applicant states these awards were not entered on his DD Form 214. 3. The applicant provides: * certificate for the award of the Legion of Merit * certificate for the award of the Army Achievement Medal CONSIDERATION OF EVIDENCE: 1. On 22 December 1974, he enlisted in the U.S. Army Reserve (USAR) and served continuously until his retirement. 2. According to his official military personnel file (OMPF) his last period of extended active duty was from 5 January 2006 to 2 December 2007. His DD Form 214 for this period does not show the award of the Legion of Merit. It does show he was awarded three Army Achievement Medals. 3. The applicant provided two award certificates awarding him the: a. Army Achievement Medal for meritorious achievement from 24 March 2014 to 4 April 2014; and b. Legion of Merit for exceptionally meritorious service from 14 July 2004 to 13 July 2014. 4. Both certificates contain permanent order numbers. The certificate for the award of the Army Achievement Medal does not reflect the number of Army Achievement Medals he has been awarded. 5. There is no evidence in his OMPF showing he was awarded more than the three Army Achievement Medals already shown on his DD Form 214. 6. On 14 July 2014, he was placed on the Army of the United States Retired List. 7. Army Regulation 635-5 (Separation Documents), in effect at the time, established the standardized policy for preparing and distributing the DD Form 214. The regulation directed that the purpose of the separation document was to provide the individual with documentary evidence of his or her military service at the time of release from active duty, retirement, or discharge. It is important that information entered on the form be complete and accurate and reflects the conditions as they existed at the time of separation. DISCUSSION AND CONCLUSIONS: 1. The information entered on his DD Form 214 reflects the conditions as they existed at the time of his release from active duty on 2 December 2007. The Legion of Merit and the Army Achievement Medal were both awarded to the applicant for service after the period of active duty shown on his DD Form 214. 2. There is no evidence in his OMPF showing he was awarded more than the three Army Achievement Medals currently shown on his DD Form 214.
