IN THE CASE OF: BOARD DATE: 5 April 2016 DOCKET NUMBER: AR20150009247 THE BOARD CONSIDERED THE FOLLOWING EVIDENCE: 1. Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests the following corrections on her DD Form 214 (Certificate of Release or Discharge from Active Duty) with a separation date of 31 October 2012: * Item 12a (Date Entered AD (active duty) This Period) - correct to 16 September 2011 * Item 11 (Primary Specialty) - correct time in specialty to 2 years and 6 months 2. The applicant states these items on her DD Form 214 are incorrect. 3. The applicant provides: * Orders to active duty * Orders for deployment * DD Form 214 with a separation date of 31 October 2012 CONSIDERATION OF EVIDENCE: 1. On 29 October 2008, the applicant enlisted in the California Army National Guard (CAARNG). 2. She entered initial active duty for training on 21 April 2009. On 25 August 2009, she was released from active duty. Her DD Form 214 shows she completed 8 weeks of Unit Supply Specialist training and she was awarded military occupational specialty (MOS) 92Y (Unit Supply Specialist). 3. State of California, Office of the Adjutant General Orders 161-384, dated 10 June 2011, ordered the applicant to active duty as a member of her Reserve Component unit effective 16 September 2011. 4. On 31 October 2012, she was released from active duty. She did not have any lost time or non-creditable service. Her DD Form 214 with a separation date of 31 October 2012 provides the following information: * Item 11 - shows zero years and 1 month in MOS 92Y * Item 12a - 16 September 2012 (2012 09 16) * Item 12b - (Separation Date This Period) - 31 October 2012 (2012 10 31) * Item 12c (Net Active Service This Period) - 0001 01 15 (1 year, 1 month, and 15 days) REFERENCES: 1. Army Regulation 635-5 (Separation Documents), in effect at the time, established the standardized policy for preparing and distributing the DD Form 214. a. All MOS titles, years, and months served in for a period of 1 year or more were entered in item 11 of the DD Form 214. b. The beginning date of the continuous period of active duty for which the DD Form 214 was being issued was entered in item 12a of the DD Form 214. The date of separation was entered in item 12b and the net service for the period shown was computed by subtracting item 12a from item 12b and then deducting any lost time and non-creditable service after the Soldier's expiration of term of service. 2. Department of Defense Financial Management Regulation (DODFMR) 7000.14-R, Volume 7A, Chapter 1, paragraph 010104 states that when computing a period of service each month is considered to have 30 days regardless of the actual number of days in the month. When subtracting the beginning day of service from the ending date of service 1 day is added to account for the inclusive date. DISCUSSION: 1. The applicant's DD Form 214 with a separation date of 25 August 2009 shows she was awarded the MOS 92Y upon completion of her initial active duty for training. At the time of her release from active duty on 31 October 2012, she had completed 3 years, 2 months, and 6 days in MOS 92Y. 2. State of California, Office of the Adjutant General Orders 161-384, dated 10 June 2011, show she entered active duty on 16 September 2011. The entries in Items 12b and 12c of her DD Form 214 with a separation date of 31 October 2012, clearly shows the entry in Item 12a is in error. 3. Her net service in Item 12c must be re-computed by subtracting the corrected date in Item 12a from the date in Item 12b: 2012 10 31 Item 12b - 2011 09 16 corrected Item 12a 01 01 15 +1 inclusive date 01 01 16 corrected net service //NOTHING FOLLOWS// ABCMR Record of Proceedings AR20150000953 Enclosure 1 ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS ABCMR Record of Proceedings (cont) AR20150009247 2 ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS Enclosure 1 ABCMR Record of Proceedings (cont) AR20150009247 3 ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS Enclosure 2
