Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests reimbursement for a personally procured move (PPM) performed prior to the issuance of separation orders. 2. The applicant states that it was necessary for his wife to move in June 2014. His wife is an educator and contracts for educators began every year in July. His terminal leave did not began until December 2014. He explained his situation to the Joint Personal Property Shipping Office (JPPSO) located at Fort Carson, CO. He was told to include a memorandum outlining the circumstances. It was never explained to him that he needed any other documentation for his PPM. It was his understanding that this issue was a normal occurrence and the memorandum would be sufficient. His transportation office instructed him to continue with his course of action with the exception of including a memorandum outlining the circumstances of moving his dependents before his terminal leave date and keeping record of all items related to the move. 3. The applicant provides email correspondence. CONSIDERATION OF EVIDENCE: 1. The applicant enlisted in the Regular Army on 25 July 2011. He completed basic combat and advanced individual training and he was awarded military occupational specialty 68W (Healthcare Specialist). 2. On 24 October 2014, Headquarters, U.S. Army Garrison, Fort Carson, Fort Carson, CO, published Orders 297-0021 releasing him from active duty and transferring him to U.S. Army Reserve Control Group (Reinforcement) effective 25 January 2015. The orders stated in part that he was authorized shipment of household goods (HHG). 3. On an unknown date, he submitted an exception to policy (ETP) request to process an after-the-fact PPM. 4. Email traffic regarding the disposition of his request is as follows: a. On 11 February 2015, the JPPSO-North Central, forwarded the ETP request to Headquarters, Department of the Army, Deputy Chief of Staff, G-4, for review. b. On 6 May 2015, an official at Headquarters, Department of the Army, Deputy Chief of Staff, G-4, denied the applicant's request. The official stated that a PPM prior to the issuance of orders should be authorized by the Military Personnel Division (MPD) before the move and based on an exigency within MPD. The applicant did not indicate that he had contacted his MPD or the transportation office prior to moving his HHG. The applicant was advised that he could submit an application to the Army Boards for Correction of Military Records. REFERENCES: 1. The JFTR, paragraph U5320-D, states HHG transportation is authorized by the transportation mode that provides the required services satisfactorily at the least cost to the government. Personally-procured transportation and non-temporary storage may be personally arranged by an eligible member or next of kin (in the case of a member's death). Transportation cost claims should be prepared and submitted in accordance with service regulations and the government cost limit is based on the member's maximum HHG weight allowance. 2. The JFTR, paragraph U5330-G(a), states HHG transportation (before a permanent change of station (PCS) authorization/order is issued) is authorized if the request for transportation is supported by a statement from the PCS authorizing/approving official or a designated representative that the member was advised before such an authorization/order was issued that it would be issued. 3. Army Regulation 55-71 (Transportation of Personal Property) provides policy and procedures for the PPM method of moving personal property. It states, in pertinent part, that the PPM program is offered to military members as an alternative method of moving their HHG in which they can earn a monetary incentive payment up to 95 percent of the Government Constructive Cost (GCC) or of what it would have cost the government to move the authorized or actual HHG weight commercially. DISCUSSION: 1. The evidence shows the applicant failed to follow established regulatory procedures and he had neither separation orders nor the proper authorization prior to procuring transportation of his HHG. 2. The applicant contends that that it was necessary for his wife to move in June 2014 because she was an educator and contracts for educators began every year in July. It is reasonable to presume that he did not act with intent to defraud the government. 3. Given the fact that the applicant completed movement of his HHG prior to the publication of his orders and at an expense that is possibly less than the GCC, it is in the best interest of the Army and the applicant to grant him relief in the form of payment of the GCC for the movement of his HHG. 4.
