THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of item 3 (Social Security Number (SSN)) of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his SSN as 555-XX-XXXX instead of 905-XX-XXXX. 2. The applicant states he believes the error in his SSN occurred when he reported for training without his SSN card and a new one was issued; however, he used his original SSN his entire life. 3. The applicant provides: * DD Form 214 * DA Form 256A (Honorable Discharge Certificate) * Letter Orders CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant's military record contains an undated DD Form 398 (Statement of Personal History) that he completed during his induction processing. Item 13 (Employment) contains a block for the SSN wherein he entered his SSN as "555-XX-XXXX." 3. On 2 December 1969, the applicant was inducted into the Army of the United States for a period of 2 years. The DD Form 4 (Record of Induction) prepared during his induction processing lists his SSN as 905-XX-XXXX. 4. The DA Form 20 (Enlisted Qualification Record) prepared upon his entry on active duty lists his SSN as 905-XX-XXXX and 555-XX-XXXX; however the “555-XX-XXXX” listing is lined through. The applicant's Official Military Personnel File (OMPF) includes the following documents prepared upon and subsequent to his entry on active duty that list his SSN as 555-XX-XXXX: * DA Form 369 (Police Record Check), dated 4 December 1969 * DA Form 428 (Application for Identification Card), dated 6 October 1970 * DA Form 873 (Certificate of Clearance and/or Security Determination) dated 22 April 1971 5. The applicant's OMPF contains multiple documents that list his SSN as either "555-XX-XXXX" or “905-XX-XXXX." 6. On 10 September 1971, the applicant was honorably released from active duty and transferred to the U.S. Army Reserve (USAR) to complete his remaining service obligation. He completed 1 year and 9 months of total active military service. The DD Form 214 he was issued at the time lists his SSN as "905-XX-XXXX." 7. The applicant provides the following evidence that documents his continual military service in the USAR during the period 11 September 1971 through 1 December 1975 that lists his SSN as 555-XX-XXXX: * Department of the Army, Office of the Adjutant General, USAR Components Personnel and Administration Center, St Louis, Missouri, Letter Orders Number S-06-404661, dated 20 June 1973 * DA Form 256A (Honorable Discharge Certificate) dated 1 December 1975 REFERENCES: Army Regulation 600-2 (Name and Birth Data, Social Security Account Number (SSAN), and TIN), effective 1 July 1969, announced the use of the SSAN in lieu of military service numbers. A TIN would be issued during the pre-enlistment processing for entrance in the active Army to those individuals who did not have an SSAN. The TIN was a 9-digit number that always began with the number "9." Upon receipt of an SSN, the TIN entry on all records would be lined out and the SSN would be entered. DISCUSSION: 1. The applicant's OMPF contains documents that list two different SSNs throughout his military service. The evidence of record confirms the SSN he claims is correct is the same SSN he provided during his enlistment processing and as listed on multiple documents contained throughout his OMPF. He also indicates his belief that he was issued a new number when he reported for training without his SSN card. This new number and/or TIN is also listed on other documents contained throughout his military record. 2. For historical purposes, the Army has an interest in maintaining the integrity of its records. The data and information contained in those records should reflect the conditions and circumstances that existed at the time the records were created. In this case, the applicant’s record lists his SSN on some documents and it also lists his TIN on other documents; both throughout his military record. His TIN is currently listed in item 3 of his DD Form 214; however, the SSN is not listed on his DD Form 214. Accordingly, it would be appropriate to add an entry in item 30 (Remarks) of his DD Form 214 to show his SSN as listed on his DD Form 398.
