The Board further determined the evidence presented is insufficient to warrant a portion of the requested relief. Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show his complete special skill identifier (SSI) and all of his military education and assignments. 2. The applicant states that his DD Form 214 is incomplete because it does not show all of the information pertaining to his military service. He states that he completed the Instructor Course and was awarded Special Qualification Identifier (SQI) "H" (Instructor) as part of his SSI code. He also completed Airborne training, the Officer Basic Course, Officer Advanced Course, and Commander's Course. In addition, he served at Fort Jackson, SC; overseas in Korea, and with the Berlin Brigade in Berlin, Germany from January 1988 to December 1990; and with the 1st Battalion, 119th AC/RC [not specifically identified]. 3. The applicant provides no additional documentary evidence in support of his application. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant was appointed as a Reserve commissioned officer in the rank of second lieutenant on 28 May 1986. He entered active duty on 10 June 1987. 3. He attained the rank of captain/pay grade O-3 on 1 December 1991. 4. A review of the applicant's military personnel records revealed the following documents related to his successful completion of military training: * two U.S. Army Training and Doctrine Command Forms 1059 (Service School Academic Evaluation Reports) that show he completed the – * Infantry Officer Basic Course on 25 November 1987 * Infantry Officer Advanced Course on 19 June 1991 * Command and General Staff Course Form 128 (Certificate of Course Completion) that shows he completed the Combined Arms and Services Staff School Course on 16 December 1993 5. The applicant's DD Form 214 shows he entered active duty this period on 10 June 1987, was honorably released from active duty on 1 April 1999, and transferred to the U.S. Army Reserve Control Group (Reinforcement). He had completed 11 years, 9 months, and 22 days of net active duty service this period. It also shows in: * item 8a (Last Duty Assignment and Major Command): Company B, 2nd Battalion, 189th Infantry, U.S. Army Forces Command * item 8b (Station Where Separated): Fort Bragg, NC 28307-5000 * item 11 (Primary Specialty ): 11A 5P, Infantry; 11 Years, 3 Months * item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized): the Parachutist Badge is one of his authorized awards * item 12 (Record of Service), block f (Foreign Service): "0000 [Years], 00 [Months], 00 [Days] * item 14 (Military Education) – * Combined Arms Staff Service School Course, 1993 * Officer Advanced Course, 1991 * Officer Basic Course, 1987 7. A review of the applicant's military service records failed to reveal evidence that he was awarded SQI "H," that he completed the Commander's Course, or that he was assigned to 1st Battalion, 119th AC/RC. REFERENCES: 1. Army Regulation 600-8-104 (Military Personnel Information Management/ Records), in effect at the time, prescribes policies, operating tasks, and steps governing military personnel records. It shows the Officer Record Brief is produced from information contained in the Officer Master File. It is routinely updated and produced (on at least an annual basis) throughout the officer's active duty military service. After the officer's separation from the Army, the Officer Record Brief is not updated. 2. Army Regulation 635-5 (Personnel Separations – Separation Documents), in effect at the time, prescribes the separation documents that must be prepared for Soldiers on retirement, discharge, release from active duty service, or control of the Active Army. a. It shows that the DD Form 214 is a summary of a Soldier's most recent period of continuous active duty. The purpose of a separation document is to provide a brief, clear-cut record of active duty service at the time of release from active duty, retirement, or discharge. Therefore, it is important the information entered thereon is complete and accurate as of that date. b. The source documents for entering information on the DD Form 214 will be the Personnel Qualification Record, Officer Record Brief, enlistment/ reenlistment documents, personnel finance records, discharge documents, separation orders, Military Personnel Records Jacket, or any other document authorized for filing in the Official Military Personnel File. c. Table 2-1 (DD Form 214 Preparation Instructions) contains item-by-item instructions for completing the DD Form 214. It shows for: * item 8a, enter last unit of assignment and major command (i.e., two character command code) * item 8b, enter Army station or installation and State where Soldier is separated * item 11, enter the primary SSI or AOC; list the title with the years and months served. In determining time eligibility for listing of specialty, 16 days or more count as a month; however, do not count Basic Combat Training and Advanced Individual Training. * item 12, block f, enter the total amount of foreign service completed during the period covered in Item 12, block c (Net Active Service This Period); obtain the foreign service from Section I, Officer Record Brief * item 14, list formal in-service (full-time attendance) training courses successfully completed during the period of service covered by title, length in weeks, and month and year completed. Command and General Staff and Senior Service Colleges, Senior Warrant Officer course, and Sergeants Major Academy non-resident course may be included when successfully completed by correspondence. 3. Army Regulation 600-8-22 (Military Awards) states award of the basic Parachutist Badge requires that an individual must have satisfactorily completed the prescribed proficiency tests while assigned or attached to an airborne unit or the Airborne Department of the Infantry School or have participated in at least one combat parachute jump. DISCUSSION: 1. The applicant's records show he served overseas as follows: * Berlin, Germany from 11 January 1988 to December 1990 (35 months) * Korea from 18 January 1994 to January 1995 (12 months) a. This equates to a total of 47 months of foreign service or a total of 3 years and 11 months of foreign service. b. Item 12, block f, of his DD Form 214 does not show this total amount of foreign service. 2. Item 14 of his DD Form 214 shows he completed the Combined Arms Staff Service School Course, Officer Advanced Course, and Officer Basic Course. 3. There is no evidence of record that shows the applicant completed the Commander's Course. 4. He was awarded the Parachutist Badge, which is sufficient evidence to establish that he completed the Basic Airborne Course. The available records do not show when he completed this course, but it may be listed on his DD Form 214 without a date. 5. There is no evidence of record that show he was awarded SQI "H." 6. The applicant's Officer Record Brief shows his SSI, AOC, skills, military education, and assignment information, including his overseas service. 7. The evidence of record shows the DD Form 214 is a summary of a Soldier's most recent period of continuous active duty and that its purpose is to provide a brief, clear-cut record of active duty service at the time of release from active duty, retirement, or discharge.
