Evidence and Consideration IN THE CASE OF: BOARD DATE: 12 May 2016 DOCKET NUMBER: AR20150010223 BOARD DETERMINATION/RECOMMENDATION: The evidence presented does not demonstrate the existence of a probable error or injustice. Therefore, the Board determined the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned. _____________X____________ CHAIRPERSON I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case. IN THE CASE OF: BOARD DATE: 12 May 2016 DOCKET NUMBER: AR20150010223 THE BOARD CONSIDERED THE FOLLOWING EVIDENCE: 1. Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his military personnel records to show his discharge as 31 January 2013, instead of in July 2013. 2. The applicant states that according to the Defense Finance and Accounting Service (DFAS) records he was discharged in July 2013. His DD Form 214 (Certificate of Release or Discharge from Active Duty) shows he was discharged on 31 January 2013. He never received any payments after January 2013. His bank statements confirm his pay was discontinued in January 2013 when he was discharged. 3. The applicant provides copies of: * His DD Form 214 * USAA Federal Savings Bank statements for 31 October 2012 to 31 March 2013 CONSIDERATION OF EVIDENCE: 1. A DD Form 4 (Enlistment/Reenlistment Document Armed Forces of the United States) shows he enlisted in the U. S. Army Reserve (USAR) for a period of 8 years on 10 April 2012. He entered active duty on 10 October 2012. 2. His DD Form 214 shows he was discharged on 31 January 2013 under the provisions of Army Regulation 635-200 (Active Duty Enlisted Administrative Separations), chapter 11, entry level performance and conduct. He had completed 3 months and 21 days of active duty service. His service was uncharacterized. 3. There are no available military personnel records showing he served after 31 January 2013 or that he was discharged in July 2013. 4. An email note from an official at DFAS states the applicant's master military pay account (MMPA) date of separation (DOS) is 31 July 2013. REFERENCES: Army Regulation 635-5 (Separation Documents), in effect at the time, established the standardized policy for preparing and distributing the DD Form 214. The purpose of the separation document is to provide the individual with documentary evidence of his or her military service. DISCUSSION: 1. The available evidence shows the applicant enlisted in the USAR for 8 years on 10 April 2012. 2. He was discharged on 31 January 2013, after serving 3 months and 21 days. 3. His DD Form correctly shows his discharge date as 31 January 2013. 4. There are no available military personnel records showing he was discharged in July 2013 and therefore there are none to change. 5. DFAS is not an Army activity and the Army Board for Correction of Military Records has no authority to change DFAS records. //NOTHING FOLLOWS// ABCMR Record of Proceedings AR20150000953 Enclosure 1 ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS ABCMR Record of Proceedings (cont) AR20150010223 2 ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS Enclosure 1 ABCMR Record of Proceedings (cont) AR20150010223 2 ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS Enclosure 2
