Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests award of the Imjin Scout Insignia. 2. The applicant states he believes he should be awarded the Imjin Scout Insignia because he served in Korea at the Demilitarized Zone (DMZ). 3. The applicant does not provide any additional evidence. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 15 November 1971 and held an artillery specialty. He served in Korea from on or about 7 May to on or about 12 October 1972. He was assigned to the 1st Battalion, 15th Artillery. 3. He was discharged from active duty on 12 October 1972. His DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) shows he was awarded or authorized the: * National Defense Service Medal * Armed Forces Expeditionary Medal REFERENCES: 1. Army Regulation 600-8-22 (Military Awards) provides Department of the Army policy, criteria, and administrative instructions concerning individual military decorations, Army Good Conduct Medals, service medals and ribbons, combat and special skill badges and tabs, unit decorations, trophies, and similar devices awarded in recognition of accomplishments. This regulation does not address the Imjin Scout Insignia. 2. The IMJIN Scout Insignia was given to units or individuals serving north of the Imjin River near the DMZ and/or for participation in operational missions along the DMZ. This badge is not an official award issued by the Army. It was a locally authorized and issued item. The insignia is available for purchase from certified vendors of military memorabilia. DISCUSSION: While the applicant’s service in Korea may have made him eligible for the Imjin Scout Insignia, this was a locally authorized and issued item that was not an “official” Army decoration.
