THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his reentry eligibility (RE) code. 2. The applicant states his RE code is incorrect. He feels there is no reason that he should have a RE code of "3." He spoke with his local recruiter who also believes his RE code is a mistake. He is requesting correction of his RE code or that clarification be provided if his RE code is correct. 3. The applicant provides a copy of his DD Form 214 (Certificate of Release or Discharge from Active Duty). CONSIDERATION OF EVIDENCE: 1. The applicant enlisted in the Regular Army on 25 February 2009. 2. He was honorably released from active duty on 17 October 2013 to attend a civilian school under the provisions of Army Regulation 635-200 (Active Duty Enlisted Administrative Separations), paragraph 5-16. Item 26 (Separation Code) of his DD Form 214 shows he received a Separation Program Designator ( SPD code of "MCF" and item 27 (Reentry Code) shows the entry "3." REFERENCES: 1. Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel from the Regular Army. Paragraph 5-16 states Soldiers may be discharged or released from active duty for the convenience of the government up to 90 days before their expiration of term of service in order to attend a specific term at a college, university, vocational school, or technical school. 2. Army Regulation 635-5-1 (SPD Codes) provides that SPD codes are three-character alphabetic combinations that identify reasons for and types of separation from active duty. It states that SPD code "MCF" is the appropriate code to assign to Soldiers who are being voluntarily released to attend a civilian school. 3. Army Regulation 601-210 (Active and Reserve Components Enlistment Program) covers eligibility criteria, policies, and procedures for enlistment and processing into the Regular Army, U.S. Army Reserve, and Army National Guard. a. Paragraph 3-21 states that RE codes are not to be considered derogatory in nature, they simply are codes used for identification of an enlistment processing procedure. b. Paragraph 3-22 states that prior service personnel who were released early to attend school and received a SPD code of “MCF” may enlist without RE code waiver. 4. The SPD/RE Code Cross-Reference Table, dated 1 December 2006, shows the RE code “3” is appropriate for SPD code "MCF.” DISCUSSION: 1. Based on the evidence, the applicant was separated under the provisions of Army Regulation 635-200, paragraph 5-16, early separation to further his education; the appropriate SPD code for this type of separation is "MCF" and RE code “3” was commensurate with this SPD code at the time of his release from active duty. 2. Army Regulation 601-210, paragraph 3-22 states that prior service personnel who were released early to attend school and received a SPC code of MCF may enlist without RE code waiver.
