THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests, in effect, correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show his deployment to Bosnia and the following awards: * Army Achievement Medal (AAM) * Armed Forces Expeditionary Medal (AFEM) * North Atlantic Treaty Organization (NATO) Medal 2. The applicant states all of his awards are not listed on his DD Form 214. 3. The applicant provides: * DD Form 214 * Enlisted Record Brief * DD Form 1351-2 (Travel Voucher or Subvoucher) * Certificate of Appreciation * orders * Memorandum for Record (MFR), subject: 3rd Battalion, 82nd Field Artillery Personnel Deploying to Bosnia-Herzegovina, dated 9 February 1999 * Biographical Sketch CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant entered active duty on 8 July 1998. 3. His enlisted record brief contains the following pertinent information: a. Section D (Overseas Service) he served a tour in Bosnia from 22 February 1999 to 12 September 1999. b. Section E (Awards and Decorations) shows the: * AAM * NATO Medal * Army Service Ribbon (ASR) * AFEM 4. An MFR, issued by Headquarters, 3rd Battalion, 82nd Field Artillery, 1st Cavalry Division, dated 9 February 1999, lists the applicant’s name as one of the personnel deploying to Bosnia-Herzegovina in support of Operation Joint Forge on or about 22 February 1999. 5. He was honorably released from active duty on 7 July 2001 and transferred to the U.S. Army Reserve Control Group (Reinforcement). His DD Form 214 shows in: a. item 12f (Foreign Service), the entry "0000 00 00" indicating he did not complete any foreign service. b. item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized): * Army Lapel Button * ASR * Marksman Marksmanship Qualification Badge with Rifle Bar c. item 18 (Remarks), no entry indicating any deployments REFERENCES: Army Regulation 635-5 (Separation Documents), in effect at the time, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It established standardized policy for preparation of the DD Form 214. It stated for: a. item 12f, enter the total amount of foreign service completed during the period covered by the DD form 214. b. block 13, list awards and decorations for all periods of service in the priority sequence specified in Army Regulation 600-8-22 (Military Awards). c. item 18, for an active duty Soldier deployed with his or her unit during their continuous period of active service, enter the statement "SERVICE IN (NAME OF COUNTRY DEPLOYED) FROM (inclusive dates for example, YYYYMMDD - YYYYMMDD)." DISCUSSION: 1. Records show he served a tour in Bosnia from 22 February 1999 to 12 September 1999 (6 months and 22 days). This foreign service is not shown on his DD Form 214. 2.
