THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show the Defense Meritorious Service Medal. 2. The applicant states he was awarded the Defense Meritorious Service Medal after he retired from active duty. 3. The applicant provides a copy of the award order in support of his application. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 26 April 1988. He was awarded military occupational specialty 13B (Cannon Crewmember). Through a series of reenlistments he continued to serve on active duty and he attained the rank of sergeant first class/pay grade E-7. 3. A review of the applicant's Official Military Personnel File (OMPF) and Army Military Human Resource Record (AMHRR) maintained in the interactive Personnel Electronic Records Management System revealed a DA Form 2412 (Defense Meritorious Service Medal Certificate) and citation to accompany the award of the Defense Meritorious Service Medal. They show the applicant was awarded the Defense Meritorious Service Medal for exceptionally meritorious service as Deployments and Procurements Noncommissioned Officer (NCO) in the Charge, Logistics Division, Directorate for Human Intelligence, Defense Intelligence Agency, from February 2003 to April 2008. The award certificate shows it was issued on behalf of the Secretary of Defense, on 4 March 2008, under the signature of William B. H____, Senior Executive Service, Deputy Director for Human Intelligence. This review failed to reveal a copy of the award order. 4. The applicant's DD Form 214 shows he was honorably retired from active duty on 30 April 2008. He had completed 20 years and 5 days of net active service during this period. In support of his application the applicant provides a copy of Defense Intelligence Agency, Washington, DC, Military Personnel Awards Order Number 81-21, dated 21 March 2008, subject: Announcement to Department of Defense Award, that shows the applicant was awarded the Defense Meritorious Service Medal for the period of service from February 2003 to April 2008. 6. A review of the applicant's OMPF and AMHRR revealed he may be authorized an additional military award/decoration. 7. Three DA Forms 1059 (Service School Academic Evaluation Reports) show the applicant successfully completed the following military education/training: * Primary Leadership Development Course on 29 August 1991 * Unit Supply Specialist Basic NCO Course on 3 June 1994 * Unit Supply Specialist Advanced NCO Course on 17 December 2004 REFERENCES: Army Regulation 600-8-22 (Military Awards) provides policy, criteria, and administrative instructions concerning military awards and decorations. The NCO Professional Development Ribbon was established by the Secretary of the Army on 10 April 1981. It is awarded to Active Army, Army National Guard, and U.S. Army Reserve Soldiers for successful completion of designated NCO Professional Development courses.
